I did a showing the other day with a nice guy who paid for the background check. Credit score: 723.

He wanted to see a generic lease before signing. He wrote back and said he had to big concerns:

1. The policy of overnight guests for more than 5 nights in a calendar month without my consent.

2. The prevailing party in a legal action pays the legal fees of the winner.

We had a few back and forths, and then this:

"I'm sorry, but I just can't sign a lease like that in good conscience. It's a shame, because the place seems great and you seem like a forthright and upstanding guy, so most likely everything would be fine, but I'm just not willing to put myself at such an extreme and unusual contractual disadvantage with regards to my home. Good luck renting the apartment -- I'm sure it won't be much of a problem in this market!"

Weird situation.

Normally tenants don't even read what they sign, then break all rules.

Refusing to sign for the two reasons you mentioned was a pretty good indication that this tenant was going to break the rules. --99.59.x.xxx

I appreciate the fact that this guy was so diligent. He self-screened and saved us both a lot of trouble. Fred is right. When I sign a lease I go over it line-by-line with the tenant.

Even then they act shocked when they violate it and are contacted.

As far as my prospect, I wonder how many landlords in this market don't have those lease provisions. --76.120.xx.xx

Danno, none without permission (I hadn't typed that original post very well). It is hard to enforce, of course, but I have used it when I have noticed unknown people entering a building with a key. Also, reports have come from other tenants who resent having to cover their share of common utilities. --76.120.xx.xx

Sounds like he was going to have a roommate/girlfriend move in. Maybe temporary, maybe permanent. Either way, you definitely dodged a bullet. The winner pays legal fees is somewhat standard. Not hard to not do something that would cause a lawsuit. --72.209.xxx.xxx

I had someone sort of like this back in 2010 with my first rental. This person demanded to see mortgage documents for the house before they would apply. This was during the all the foreclosures so maybe he had reason to be concerned but I didn't like the manner in which he asked, he came across very strong. It is a big deal. Here's why. you run the app based on who applied. we make it clear that when the lease is signed-- should they move anyone else in (like they all try to do- to pull one over on OL Mr. LL- that person must be approved with an application and info and an additional 70.00 per person over the age of 18 must be tendered. Some apply knowing full well they will be moving others in-- and who gets stuck with them?

We have had several try to do it. We stick to our guns and either they supply and pay or the lease is terminated. ALL eventually comply. --99.103.xxx.xxx

Both of those clauses (first definitely, second at one time) are in the standard Realtor boilerplate leases here. Yep, he was going to be a problem.

While I understand why, it is a little red flag for me when they want to see a lease before committing. Of course i always provide one (as required by law). But it does say they maybe a problem. --108.51.xxx.xxx
