Is it discrimination of a sort if I say Coast Guard members go to the front of the line? We have two bases within decent distances of our places, and we have rented to several Coasties with great success in the past (and present, actually!)

I actually have one leaving soon as his service is ending and they are leaving the area. I just had one inquire and honestly, I'd take him pretty much sight unseen.

Is that discrimination? --184.188.xxx.xx

Pretty sure it would not be a problem. I welcome service members, they clean and pay on time. They want zero problems with their CO. --174.105.xxx.xxx

Is it discrimination? Yes, of course. The better question is: is it ILLEGAL discrimination? I would say it is not. I don't see any Protected Class being discriminated against here.

Is it illegal? Probably not, unless occupation is a protected class in your state.

Could someone still sue you for it? You bet.

Would they win? Depends on your state laws again. My guess is no. Businesses give special discounts and extra considerations to members of the Armed Services all the time. There would be a lot of precedent on your side. My advice is don't advertise it as such and the odds of anyone knowing what you're doing are slim to none.

Don't you loving living in "the land of the free" where we never know when a lawsuit is just around the corner? ;-)

Here upscale apartment complexes openly advertise for certain professions,...like Registered Nurses but not LPN or CNA's. In addition to RN,..Honda and Goodyear union employees are on the 'preferred recruitment' list.

Had a women apply with two children where on the credit report she owed over $700 on the cable and cell phone. As the vacancy in the province of Ontario is extremely low or no vacancy rate at all rental housing providers will not touch anyone below the seven hundreds. No matter the source of income responsibility has to shown utility bills along with other bills are paid. Unpaid utility and other bills is the way rent is going to be paid. She said she was going report me to human rights as this was discrimination. Where I told her rent had to come from directly from social assistance. She declined where later they renege on that agreement. Had another couple told them they reapply if they fixed the negative credit report which involved paying thousands in arrears. They declined no human rights issue. It is a small cost upfront where running thorough credit checks on all adult applicants avoids handing the keys through the gates of hell. Being consistent that everyone is treated the same. It always know what you are getting into before hand. More often then not was only out of cost of photo copied rental applications as they already know they are disqualified where never came back. --147.194.xxx.xx

Or better yet, don't advertise anywhere but on base. If they are the only ones who know about the vacancy then they will be a majority of the applicants.

Get chummy with the commissary and stores on base. Ask them to post your ad. Offer them money for better placement if it's possible. --108.69.xxx.xxx

Contrary to what most believe, Discrimination is NOT illegal.

You just can't discriminate against certain specified classes - race, color, creed, national origin, sex, etc, etc.

Occupation is NOT one of the classes you can't discriminate against or FOR.

So, go ahead and discriminate FOR Coasties. I do the same thing. --73.16.xxx.x

When I had my add up for my rental it was worded towards students and it was suggested to me that I reword my add as that might have been considered steering or something along those lines. Would this not be a similar thing? If not then I don't know what would be wrong with it. It might be a little risky tacking someone sight unseen though. --73.120.xx.xxx

LLOTF, interesting you say that because I have read that you definitely don't want to advertise only in a Christian church or you could be accused of discriminating against non-Christians. Then again, that could be argued discrimination based on religion. --24.20.xxx.xxx

I tend to think backward direction on this

start with being sued then what would the prosecutors be looking for from you

In the file is......?

will you have show all the other applications that were refused because of the Coast Guard acceptance

will you have to show your printed standards and does it have a section for references, etc

In common sense America I see nothing wrong with the CG being accepted based on your track record with the CG - that won't be something you have in your file because you will have the completed app, etc. by that time

I am pretty sure up here in NH I don't live in the America you all now experience --24.62.xxx.xxx

6x6: The "student" advertising thing is a little different because some seem to see that as discriminating against familial status -- which IS a Protected Class.

In this case, I assume that the military people would still have families and such, yes? Or no? If yes, then I think no problem. If no, then I could see someone trying to argue the same thing.

JB, yes. And if that was the case, my opinion would be totally different since religion is a protected class. However, occupation isn't so I should say that my advice is specific to non-protected class locations. Since all races, religions, etc. are in Coast Guard, I'm sure you're covered.

I would be more comfortable putting these ads in places where only Coast Guard would see them than I am publicly placing an ad that lists Coast Guard preferred for everyone to see. Too many lawsuit crazed people out there that don't understand the law or just want to be an activist at my expense. --108.69.xxx.xxx

No Coasties here inland, but I have had several Navy and Marines. The officers were great, but the one enlisted guy was my worst nightmare. Hence I avoid non-officers like I avoid people with ESAs. Always with a good, defensible reason like income, of course. --71.175.xxx.xxx
