Eight in a 3 occupant house, lease was consigned from the previous two tenants, deposit depleted, utils in previous tenant's name, lock changed; two thirds May rent was tendered.

Present tenant unscreened, gratuituous vandalism noted: what would be your sequence of events? Rent remainder and wait and see for June, right?

Really what to do about the lock, lease, and utilities. I realize some of this likely will play out happily hopefully. Silver bullets? --24.74.xxx.xx

Go back to the basics: background check, lease, rules, and follow-through. That is with ANY tenant, no matter how acquired. Never just wait and hope, but, there is sometimes a rare occasion to wait someone out. But no hoping they comply. Have a plan if they do comply, a plan if they don’t. No way would I let a newly acquired tenant set up their rules.

If I understand this situation, and I might not, your tenants allowed friends to move in, your tenants may have move out, but your tenants are still paying utilities, and May’s rent has not been fully paid. Simple solution: follow your state’s laws, your lease’ guidelines, and issue proper Pay or Quit to everyone. Get as many names on there as you can, and use the phrases ‘et al’, or ‘ and all others’, or whatever your state requires. Post that pay or Quit several ways, including by mail and posted on the door. Put a contact phone number on that form and clear payment instructions. Probably all of this should be done with help from an attorney who specializes in evictions in your court area. The ideal situation would be that rent is paid, new occupants can be properly screened, utilities switched to new tenants’s name, new lease signed. That is not very likely, and certainly won’t happen unless you lead.

Letting these tenant behaviors go uncorrected is a self-inflicted wound. There doesn’t have to be an eviction here, BUT, there does need to be leadership from you. Tenants will do what you allow. Guide them back, swiftly, firmly, to the right path.

Eviction would have been filed on the 8th due to non-payment of the full rent. All the other issues have to be proved/argued, but unpaid rent is a slam dunk win in eviction court for me. --173.20.xxx.xxx

The troublesome problem of privacy necessitates disguised expression; sorry I can't help that. Every time I come here usually someone comes back and reminds me you can't hide, and you certainly can't evade the eye in the sky;)

Aw shucks.

But a group of ppl, possibly a realtor's plant, moved in at the invitation of the previous tenant. They have no lease, weren't screened, have no visible means of support for the most part and are corralling myself to give them sympathy.

Any security was eaten up with damage to the lawn, a disappeared vanity, new appliances switched, extensive refuse the super had to remove, 5 pit bulls two of which were shot trespassing by the son of the sheriff at the hill crest, two hoop size holes in dry wall etc. etc. etc. ad infinitum. And I have a new cancer needing endorphins. --24.74.xxx.xx

My first call would be to the police to remove squatters.

My lease is clear: Management does not accept late or partial payments.

So hold the money-not accepted. Do not give it to these people. You are not required to accept payment.

If no help from police, file for an emergency eviction based on the threat of more damage to your property.

My technique: go there and take a pic of all IDs. Tell them the sheriff will be over soon the lock them out and pit your stuff on the curb. Pay an off duty cop $50 to escort you.

Normally these are deadbeats and your res left to get away from them. Hopefully they scatter like roaches when the light comes on.

Follow your state and local tenant rules, you seem unsure what to do, visit housing court a month or 2 and choose a lawyer who gets in and out without a lot of bulloney - hire them and standby to get your place back, screen better and deduct damages from the deposit after moveout, next tenant - bill next rent cycle for damages. --76.188.xxx.xx

Live not on evil, you really do need to use straight talk, instead of clever hints on a public forum. Too hard to decipher the ‘ tone ‘ in which things are being ‘ said’.

Tenants that do not have a cell phone still can be dealt with, every bit as easily as those without. Post your notices on the door, and in the mail. You do seem unsure of what to do, as Vee said. And when one is unsure, the state and local laws should be followed with NO exceptions. That last bit you added on about exceptions for brown sounds rascist. Rascism has no place in this business. Well, OK, alright. You have responded to the corrections about using simple language on the forum, and you claim you follow everything to the letter of the law. But, have you given thought to doing the things that very experienced landlords and property managers have advised? I do not count myself among the very experienced, but, certainly, Vee, Sid, Brad ARE very experienced and successful.

The word law assumes impartiality which may be a chimere since the police are politicized. NC is notorious for vague statues and if you don't believe me check out the protocol for deposits. They are to be put in a non interest bearing account; oh really now no kidding kiddo.

Cool blooded WI doesn't leave so much dangling I bet.

And the return of deposits, so much is left up to the discretion of the landlord; wait 30 days and include an itemization.

Someone comes in and decides to wreck the place this isn't FL with 48 hr evictions, either. Holes in the wall, killer pit bulls, damaged grounds. Let me see....? --24.74.xxx.xx

NC has very easy to work with laws, is my understanding, but, this last post, it sounds like that lack of specifically spelled out is not comfortable for you. That’s when you need to write down your OWN plans to handle things, check your set of rules against the state and locals laws, and judge/ court commissioners’ interpretation. Build you own plan, so you don’t have so many details ‘dangling.’ --70.92.xxx.xxx

I don't have counsel retained and am not a walking encyclopedia but I have navigated the waters. You think you know more than I do about NC and applicable laws. Rest assured the laws are not so complicated as the recipe for oxycontin. I've had guns pulled on me by line judge ppl.

I know the fundamentals; you have to pay the rent, you aren't compelled to house anyone period, tenants must be of sound character and bear no prejudicial judges. Hello, I'm just getting started. Go down to the public library and pick up the folder pamphlet the NC Bar Assn publishes every year. Reads like the farmers' almanac. Still an authority on NC landlording? --24.74.xxx.xx
