Dear sir/madam:

Our no more three unrelated ordinance now come back after several city hearings, It is still under discussion cross whole city communities! Now most tenants and landlords are against this ordinance .

I have a question here , I heard in Mass state ,if one lives in a rental unit more than 30 days , he/she will be default as legal tenant by housing court or mass house law though her/his name is not in the lease . If that is the case, that will be landlords or tenants ‘ arguments against this ordinance

Any advice ?

While the number of vacant rental is declining it is unreasonable to ask rental housing providers to accept criminals who will impair the safety of other tenants along with rental housing providers which may involve the distribution of illegal, fire arms or other illegal activity. If I understand you correctly, it sounds like you are addressing two different issues.

1) No more than 3 unrelated people may share a single family home. This is pretty common - it is here, where I live. To me, that just means that if I intend to rent to roommates, I don't buy a house with more than 3 bedrooms.

2) If someone moves in - even without the landlord's knowledge or consent - they can quickly establish themselves as having rights of a tenant. I believe it, especially in MA. Good luck with that. I guess the best you can do is screen very carefully to try to eliminate the type of tenant who will invite their whole family to move in, or who have significant others who are criminals. Try to keep up with cars that are there all the time - that do not belong to your tenant, and question it. Hopefully, an experienced MA landlord - to attorney - can suggest ways to help protect yourself. --68.10.xxx.x

My question is

I heard from people , in mass , there is law

If one not on lease lives the rental unit for more than 30 days , they will become tenant .

It is hard for me landlords to monitor my rental places every day and night . Most time , number of living in a rental place is more than one on the lease

I would like to confirm whether the 30 days change a person to be a tenant ?

There is a term in MA called Tenant at Sufferance. I believe it refers to any one taking up residence on your property without any legal right, ie no rental agreement. You have to evict as if legal tenant --45.19.xxx.x

after the 6th meeting and discussion about the 100 years' old ordinance : no more three unrelated tenants allowed in our city, the city commissions said that there would be one more meeting.

basically since it is unenforced ordinance in modern society, city most likely takes modern ordinance : sanity code as standard.

It means sf/person . We will say what happen next time.
