I had a tenant who leaglly moved out the house into a nursing home . His niece was handling his affairs and was his power of attorney. She sent me an email with his new address and another email following up on the return of his security deposit. I mailed out the SD refund check to the attention of my tenant's name within the allotted time frame for my state (45 days). I later learned from a neigbor that my tenant had already passed away within that time frame and the niece did not inform me. The niece cashed the check on his behalf. My question is was she entitled to do so?

I wouldn't worry about it. If he had an estate, it went into the estate checking account. If no estate, she probably put it into his personal account. Either way, what does it matter to you? --72.70.xxx.xxx

If she was the executor or had power of attorney, that was legal.

If it wasn't legal, it wasn't your money and you have proof you complied with state law about returning the deposit. If she stole it after that, it isn't your problem.

I wouldn't worry about it. Your neighbor is obviously nosy and apparently trying to get you involved in something you have no business worrying about.

You returned the SD within the time that you were suppose to and to where you were informed to do so. the end.

If (IF) the estate or whoever comes back and states "We didn't get the money" or whatever - all you can do is provide them with the cancelled check copy. They can do the investigating if they need to from there.

Wouldn't worry about it. If she was able to cash it, it means she had signature access to his account. More than likely she used it to cover estate expenses anyway.
