How do you verify ESA? We have a prospective showing us ESA letter for her two dogs and on the prescribed animal's description it only stated 2 dogs and the dog's name.

Nothing about the type of dogs or description.

I was expecting more details.

There is no requirement that the documentation from a healthcare provider shows the names, types, breeds, or anything else about the animal. In fact, they don't have to even know what the specific animal is. (Some people without an ESA might go to a doctor, get the letter first, and then go find the ESA -- so the doctor would have no idea what it actually was so couldn't provide those details even if they wanted to.)

If they have the proper documentation -- which would be basically something from a healthcare provider stating that they have a disability and the accomodation would help them to have an equal opportunity to use and enjoy the community/apartment/house/whatever -- then that is likely all that is needed.

And, be careful about NE's last statement. Much has he WANTS to have "nothing online" as far as the letter goes, that isn't what the federal law states you can require. So, unless you have state laws backing that up, be very careful before making the requirements more difficult or specific than the federal law.

If they didn't mention animals on the application/ pre-screening then decline to rent to them. I ask about animals, not pets. So if I approve you and then you have an animal that was not previously disclosed that's a red flag. --24.194.xx.xx

Of my own experience, an existing tenant had first agreed to my terms of paying an additional pet rent, paid the first month's pet rent, then pulled this stunt of declaring the pooch to be a service animal just a few days prior to the next due rent date (actually, she presented ESA documentation). Now, she wants me to give her a break on her carport rent (She can whistle for that one, for ALL I care. No more favors!) --10.156.xx.xxx

I have proven that the documentation was a farce. A service mill for a fee provided the doctors note.

Then when I met the dog, my tenant had no papers. No license, renters insurance or medical records. The dog had never been house broken. The law says I can't collect a deposit for an ESA animal. But my tenant lives from paycheck to paycheck and has lots of credit card debt and no savings.

I gave this current tenant a letter. Please provide me with:

1) A current a valid dog licnese

2) The vet's medical records that the animal has been vaccinated.

3) Proof that this dog is not violent and will not attach other tenants or guests.

4) Proof of renter's insurance (as required in the lease) with a rider for coverage for "this dog".

5) A letter stating that the apartment was clean, free of stains and smells before you got the dog.

6) A list of those who will walk the dog while you are at work, teaching. With travel time you are away 9 hours each day. The dog will need to be walked 2 or three times during that period.

Failure to provide any and all of the above information will result in an eviction action or removal of this dog....

LiTx I don't get it, the prospect indicated on the app that they have 2 dogs and you approved them? Why? What is the issue then? Size of dog? Ask for paperwork as Robert outlines. And didn't you already contact the previous LL and would have found out it is new mgnt. that had no records of your prospect?

Yes, was just making sure I verified ESA correctly. The dogs was stated in the application, but she did not informed of them being ESA until I approved her.

It was 2 medium size dogs. I was making sure it was not a fake document, something people can make up just to get away with pet fees. --47.32.xxx.xxx

Since you have already approved them and accepted 2 months deposit it’s sounds like your only issue is verifying the ESA letter. You should have verified that before accepting them and their deposit. But.......because you seem to only be concerned with the verification of the letter, where is the letter from and what does it says. The letter should be from a Licensed Dr, Therapist, clinical social worker. It should have the full cantact information including license number, the letter should state the tenant has a emotional/mental disability and that disability requires an ESA and it should be dated and signed. But as NE said qualify the tenant first and then worry about the dog. Sounds to me as if you painted yourself in a corner, sounds like you approved the tenant and her dogs and now are worrying about the “big dogs”, unfortunately regarding ESA’s, if a tenant wants a dog it’s very easy to get a letter from their Dr whether they actually need 1 or not. So I’d take NE’s advice going forward, screen the tenant first and then the dog, most if not all can’t qualify. I believe NE’s words were “it would be a unicorn “ --71.248.xxx.xxx

They are getting canny. I just had two girls at lease signing pull out a rabbit. I said very quietly, "You told me you had no pets on the application." They said; "Well Granny bought a bunny for my daughter because it's Easter. It's very cute and fluffy." (How is cute and fluffy supposed to matter?) I offered them the choice of not taking the unit, getting rid of rabbit, or increasing rents $15 per month. They took increased rent. Next month I expect it to become an ESA. --216.23.xxx.xx
