Um, I would NOT recommend Kay's advice. Why? Because it doesn't MATTER what breed it is once they tell you it is an ESA.

I would not just note down "unknown breed" in your notes for someone that said that they had an ESA. Once they say ESA, breed really doesn't matter much as far as the law is concerned.

Don't get me wrong -- don't take this person if you don't want them -- but find a better reason than ANYTHING related to the dog once they told you it was an ESA. Denying now, based on anything related to the dog (even "breed doesn't exist") is a legal quagmire...

Never heard of those breeds at all, and certainly not a hunting dog. Of course these days, if you can identify the parents, you then string the names together and you have a designer dog. (yorkiepoo, berniedoodle, golden doodles, labernese, ) And they get big money for those mutts, more than purebreds around here. Started with the labradoodles.

Could they maybe not be good at spelling and it was "brindle" which is a coloring that is common in pits. And maybe a spitz dog which are bred more for the arctic areas.

Either way, at 27 lbs it puts in into the ankle-biter, yipper category for me. They don't seem to train well either. But that is my biased opinion.

She is probably lying about the breed and ESA for that matter.

If it went far enough I would want vet records and I think you can ask for physicion's statement on ESA. There was reference a while back on another post on a web site for scotts law.

Photo vet records are a legal request, the breed will be stated there and the fixed status with record of shots. The doctor produces the medical need, not the vet but often stated on vet records.I

Someone who refers to an "ESA" as a pet has already tipped their hand. Add to that two non existent breeds and you can guess what breed the animal is.

Don't waste your time with this hustler. She obviously is trying to pull one over on you. Just find another good prospect and find a good reason to ignore her.

I was thinking designer dog myself - so many whacky combo names these days. When my brother raved about how wonderful his Golden Doodle was, and said, "No more mutts from the pound for me!", I said, "Uh, technically - your dog IS a mutt!" Fortunately, he found it funny.

It will be a really cold day when I accept a CHERRY(remember that term) as an ESA. For one thing it's an excluded breed on my insurance and taking it would create a hardship on me. Also, a friends Pitty bit me years ago and having one in my house would really rev up my PTSD.

I'm not convinced that the person was being dishonest about the breed here. I think this was just poor communication between then and plenty.

Heck, even plenty compares it to a "Brantal"? That isn't a breed either! I think they meant "Brindle" probably?

My point is, this whole "I can't find the breed thing" could easily have just been a misunderstanding. All I'm saying is, don't decide an important LEGAL issue based on what you may have simply misheard over the phone. :)

Let them apply. Get the application. See what it says for the breed. Then deny. :)

JB: I can just give you the quick version now if you'd like. :) Brad would post and say that some local-yocal "official" told him a bunch of stuff that applies to the ADA and not the FHAA.

I would then reply and say that, as usual, Brad's advice doesn't apply to an ESA situation because the ADA doesn't apply to our situation as landlords -- that the law we worry about if the FHAA.

There ya go! Now Brad doesn't have to waste his time and you still get the fun! ;)
