Hi, A SC friend called today re: MVA.. was coming off a side road onto an one lane road taking kids to school( one lane each direction). Driving a small SUV, SC turned R and traveled about 2 car lengths when the next thing known, SC was hit on the d/s qtr panel just above the wheel well, the tire rim was skimmed with other driver's black paint. No front end damage, no damage to headlight on d/side. SC pulled over to the side of the road. The other driver who side swiped SC was driving a 2005 Chevy 4 door black SUV. Driver pulled ahead and off to the side of the road. The damage is on the passenger side; just before the rear wheel qtr panel, back by the rear door. You can see the green paint from my friend's car in this area. SC reports didn't see the other car; came out of nowhere My spouse and I have debated this to ad nauseam. Who do you think was at fault and why? This is a gender free post so as not to influence anyone.

Time: 7:11 am - dark since time has changed

Weather: cold but dry; about 45 degrees

Across for the side road is an Exxon station. Video available of stop sign.

To the left of the exit road is a slight curve but no visibility problems.

Who is at fault and why?

Traffic judge: Did SC make a full stop from the side road before turning R, whether or not there is a stop sign?

Did SC look to the L to see if there was an on coming traffic? "I didn't see anyone" is not a good answer.

With the minimum information you provided, the merging vehicle (SC) is at fault. Sorry dude.

Does SC have insurance? Does the other driver have insurance?

If yes, let the insurance companies sort it out. --99.59.x.xxx

Look left, look right, look left again. If I understand the spatial relations of it, sounds like SC forgot to look left again. Especially just after time change. Need maybe give a little longer look when light is different than what is ‘used to’. (Stupid time change. )

Two car lengths is a tiny amount of time. Couldn’t have come out of nowhere. Unless other driver was in de Lorean going 88 miles an hour.... --70.92.xxx.xxx

Clear to me it would be SC at fault.

Cars do nor come out of nowhere.

So SC admitted they did not look to see the car. And you know the car was there.

It you cant be 100% sure the road is clear dont pull out.

Would be rare that you would have a stop sign and turn that does not allow you to look down the road and see if a car is coming. No matter what speed.

In addition to what the others have said, thr point of contact appears to be SC's front fender and other driver's rear fender. That tells me the other driver was already there when SC pulled out. --174.234.xxx.xxx

The only thing that could POTENTIALLY help SC's case (as far as I can tell): did the other driver not had hedlights on?
