If the office above asks for income verification on an independent contractor...are you obligated to provide since not an employee?

It's been a rather hectic two weeks and if I don't have to spend an hour or two to get exact answers for someone who is not an employee but rather an independent contractor oh, that's preferred. On the other hand if that agency is in essence like an unemployment agency in a different state just not called that dr. Then there is no choice. Is that correct? --74.141.xx.xx

Well, this question sat here and NONE of our hundreds (thousands) of posters responded. So I will give my limited 2 cents.

-I don't see how you could possibly know what a private contractor makes! The MOST you could tell them would be what he-charged-you for a specific job. And even THAT would be hearsay/just your word.

-And I don't see how you could possibly be held responsible for a rely to their query. Any reply you had would be YOUR decision, as a courtesy. They have NO power to force anything from you. They are fishing for info on someone (for good or bad).

-Now if you liked the contractor, if he did a good job at a good price, you could give him a recommendation. I certainly know NO ONE can force ME to tell them anything about anybody without a court order. Same for you. --108.87.xx.xxx

So I am not originally from Ohio. And I wasn’t sure if it was similar to an unemployment office request. I’ve never heard of anybody in Ohio going to an unemployment office… So I didn’t know if in Ohio they just called it something different. In the state I am from if you don’t give information on an employee they will assess unemployment benefits to your account. So I want to make sure I wasn’t going to be charged --107.77.xxx.x

It sounds like you considered him an independent contractor and he decided he was an employee and filed for unemployment is that correct? I think you should talk to an attorney otherwise you will be having a problem,you will be paying unemployment but you could get in trouble for not having him on the books to start with --72.231.xxx.xxx

Your tools or his tools. His tools equals independent contractor. Your tools he's your employee is the way I heard it. Now if he comes in every day and works there all day that becomes more employee. Does he have a business license? If so I would think this is not your problem. And it seems like that office is fishing to see if the guy is your employee or not so your answer is: I don't know as he is an independent contractor. --73.248.xxx.xxx

A contractor, by definition can be employed by multiple people at a single time. So how are you suppose to know who else the contractor works for?

More importantly, if you can answer that question - are you sure you hired a contractor and not your own employee?
