I have students with parent guarantors who are all out of town but sign the lease with joint responsibility for the rent, etc. However, I am wondering how to best handle the signatures for the lease paperwork. I emailed my copy to everyone to sign before I sign the final form to return to everyone. Now I'm wondering if it makes a difference that I ended up with multiple copies that were emailed back to me, one for each party. Does it make a difference that we haven't all signed one copy? Is it acceptable that I now have 6 copies? I plan to sign each copy and return by email to everyone. --100.15.xx.xx

This is useless value of effort, students go prepaid 8-10 months, once they have provided money orders you make 1 copy and let the students disseminate a copy to family, you will go crazy trying to track down 1 out of town person for court, how ever many just multiplys the frustration. --76.188.xxx.xx

I often make the parent that is going to guarantee their child's rental payment sign the lease as a co-tenant (they come down once in a while to visit and want to stay overnight, and have them notarize it and attach a copy of their drivers license.

I had one child/parent get into a verbal fight over grades and the dad refused to help out or cover the rent. When I did the eviction, I included the parent which put a dig on his credit score. He wrote a letter to the credit agency saying he never signed the lease, it's a forgery. So I emailed to the credit company his notarized lease and identification. His FICO score went down even further for providing false information to the credit company. --47.156.xx.xx

VA does allow electronic communication. I think notarized is needed, as Robert said, to verify who signed it long distance. If you do this (long-distance) much, you may look into dousing or another service that makes it easier. I think it's a great, modern way to do business & surely has increased your success with this demographic.

And I also think you are fine, as long as everyone has signed. However, that's my personal opinion - I'm not a lawyer. Might be worthwhile to call one and ask, for the future, just to be sure. --68.10.xxx.x

I think it depends on your local court system. Here I know that all parties MUST have their signatures and initials all on the same page of the document. In the rare case there are too many signatures to accomodate on one page we need a separate form, signed by all, indicating that everyone acknowledges the existence of the additional signatures on a separate form.

The purpose of everyone signing and also initializing the page is to prevent someone from including pages or paragraphs that a signatory did not see.

You should try docusign or pdffiller where you can send documents to all parties for their electronic signatures.. --71.75.xx.xx

Thanks for the info, I did some additional searching and found a site for Code of Virginia:

(a) A record or signature may not be denied legal effect or enforceability solely because it is in electronic form.

(b) A contract may not be denied legal effect or enforceability solely because an electronic record was used in its formation.

(c) If a law requires a record to be in writing, an electronic record satisfies the law.

(d) If a law requires a signature, or provides for certain consequences in the absence of a signature, an electronic signature satisfies the law.

Seems the emailed copy should hold up if there's a problem. Also, I have a copy of each person's driver's license. However, I would feel better having everyone's signature on one document. I will look into the docusign or other software. My budget for this is small but it might same time. --100.15.xx.xx
