State Specific Question About: COLORADO (CO)
Sort of long......Tenants ( boyfriend, girlfriend & girlfriends cousin ALL were lease signers) paid rent through end of lease, moved out 2 weeks prior to end of lease, left house move in ready, received deposit refund at move out walk through. Check was made out to all 3 ie: Boy Friend & Girl Friend & Cousin, check was cashed 4 days later. New tenants moved in early and a refund was due to outbound tenants, refund check sent, made out to all 3 lease signers. I got a text today from Boy Friend saying no one will cash the check and can I reissue a check made out to him only and he'll gladly come pick it up. My thoughts, NO WAY, since all 3 were lease signers,all 3 need to be named on the check, correct? --67.143.xxx.xx |

His problem, not yours.
Call your bank and ask if this is true. I can see a bank questioning the check but I also picture him lying.

For what it's worth...
We don't refund rent when folks move out early. What is "early" anyway? Few people stay until the 31st.
I don't get a refund when I turn in a rental.car in the morning or if I don't eat all the food at a restaraunt.
I paid for a block of time to use as I wish.
Many LLs soothe their own egos or perhaps guilt by making a deal to return rent if the home rents quickly. But where is the gain? The home WAS rented and paid for already. Gotta re-rent anyway.
To re-rent (bring IN rent) then turn around and refund rent is a lot of effort for no gain.

Went to bank this morning, as I suspected only 1 of the named folks on the check went to cash it, so it IS a room mate issue. They can deal with.
(S I D and Ken )As for a refund of rent paid, in Colorado we can not, by law "double dip"on rent, tenants paid for last months rent, vacated 2 weeks early, left house move in ready and new tenants moved in a week later (paid rent), so by law we had to refund the balance due between re-renting and end of month.
Believe me I would have just rather kept the money, but since we can't, a refund was issued.
