State Specific Question About: ARKANSAS (AR)

My Resident will be moving out after 5 years. I never raised the rent since I am out of state owner. I have not yet received his last months rent and he will be giving me his 30 day notice in a couple of days. He is being cooperative in showing the house for me. Although he surprised me by telling me that he will sending me the bill for cleaning out the Dryer vent that me as the owner never had done in the 5 years of his tenancy. It caused a problem for his dryer. I want to be prepared when I get the bill. If the $ 140 is for damage to the dryer or cleaning out the vent or both. Agreement says owner not responsible for any loss, damage to personal property of tenant. He only notified me because I called him and now it is after the fact. Dryer belongs to him.

I wouldn't pay for any damage to his dryer or repair he ordered.He is distracting you from the fact that he has not paid his rent.Start an eviction now. --72.224.xx.x

His dryer got the dryer vent dirty so he should pay.

But always good to have something in your lease stating the tenant is responsiable to clean the dryer vent, since it is a major cause of fires. It may help with liability if this ever did happen. And in your case no argument with the tenant about who should pay. --76.104.xxx.xx

a) He was with you for 5 yrs, I wouldn't worry about $140 unless...

b) He doesn't pay the last month's rent.

Keep your priorities straight: You want the house re-rented quickly. Yes, the $140 is BS and isn't your fault. People should be cleaning their own dryer vent (and everything else that isn't plumbing, HVAC, or electrical related). But it's a much worse problem for you if he doesn't pay that last rent, doesn't help you show the place (since you are out of state), and doesn't leave when he says he will. If you actually did have to evict, this gets messy.

Really all he's getting is $140 off his rent but he's cleaning and showing the place for you. If he's really doing those things and being helpful, let the $140 slide. Don't lose focus. --38.127.xxx.xx
