State Specific Question About: COLORADO (CO)

I talked to a woman who claims to be a Property Manager. I got into alot of problems with her. I asked for her Liscense. She said she doesn't need one. What is Colorados guidlines on this. She gave me a copy of one of her own tenants lease. She gave me a Contract which was ridiculous and I wouldn't sign. She also gave me a list of tenants in one of her own Buildings along with their info on rent, deposits and when they moved in. Is this legal to give this info out? I pegged her as a fraud. I will continue to take care of my own Property. --72.175.xxx.xx

There is a group in our area that is doing FEE management without a real estate license which Virginia requires.

It would just take a complaint to the state real estate licensing board for them to investigate and turn prosecution over to our Commonwealth Attorney....acting without a licensence is a FELONY!

When someone approaches me and says they are a property manager, I ask them for the following:

1) Their Broker's License

2) The properties they manage, owners names and contact phone numbes.

Until I can confirm they are "legal" managers, then any dealings with them could be illegal...

Does property management require a real estate brokers license?

A:

The term "property management" is a general term, which typically refers to the care and rental of real property for others. To the extent that the service offered as a property manager includes the negotiation of a a lease or lease terms, an active real estate brokers license is required. If a real estate broker who is in the employ of another broker conducts such management, all management must be conducted under the employing broker. The Commission does not have any approved forms for leases or management agreements but it does have specific trust account and accounting requirements which brokers need to follow in handling security deposits and rental receipts. Brokers engaged in property management are also required to comply with the brokerage relationship section of the license law and applicable rules. Brokers must use the exclusive Right to Lease to establish an agency and/or Exclusive relationship with a property owner.

"Property Managers" can be employees as in OnSite or Resident Managers.

FEE PROPERTY MANAGERS who manage for others and who take $$$ - need to have a real estate broker license inmany states.

This is why OWNERS who say they are MANAGERS can get themselves in trouble if they are recorded by the prospects as saying they are property managers and MISrepresenting their true authority --184.5.xxx.xxx
