I'm a landlord and my friend is on a lease with roommates (i.e. she is a tenant who is the main point of contact with the landlord and gets other roommates to sign a month-to-month lease to live with her in the house).

A roommate assaulted her (pushing and hitting her) and my friend is going to the police department to fill out a report. She is alright but I was wondering if violence by a roommate is suffient grounds to break a lease. Please let me know your thoughts and whther she can kick a roommate out based on any laws. Thanks.

In most jurisdictions that would be considered domestic violence so any local laws related to the incident would apply. But to be absolutely sure check your local laws. --108.238.xxx.xx

She gets a restraining order and they have to leave immediately with the clothes on their back until a court date later. If she can prove it, he will go to jail if she had called the cops. --76.90.xx.xx

Best of both worlds. Tell your friend to get a restraining order. Person who did the hitting will not be allowed on the property. But (assuming they are on the lease) they can STILL be held liable for the rent. --71.191.xxx.xxx
