State Specific Question About: NEVADA (NV)
My tenant signed a lease with one free month for a 13 month lease. He is military and leaving a month early. My question is I know that military can end a leaase early with no penalty with orders but would he be responsable for the free month of rent since he will not complete the agreement on the lease? --132.3.xx.xx |

Did you already give him the free month? If you gave it to him, it's gone. It was a gift/incentive to get the place rented, it worked, and now the thing you knew could happen when you took him as a resident has happened.
Good business practice to protect your money is to require a copy of his orders to verify he's not lying. (remember, tenants DO lie!)
Most make the 13th month the free one.
Early Lease Termination Fee would solve this in a heartbeat.
If he's going to battle, I'd hug his neck, say God speed, forget this lease stuff, and re-rent quickly.
Be glad you're not trying to re-rent in winter!

If he has orders, he can terminate early without penalty.
Brad, your Early Termination Clause would not be applicable, because (if he really has orders) he is terminating pursuant to a law that trumps your early termination penalty. (Same way any other termination by right would trump that penalty provision. Some states have domestic violence termination provisions.) If the law provides an early termination RIGHT, the tenant does not have to buy the PRIVILEGE to terminate early.
