State Specific Question About: GEORGIA (GA) MY MANAGER AND i DISAGREED ABOUT THE TOTAL AMOUNT OF SECURITY DEPOSIT A POTENTIAL APPLICANT CAN BY TO MOVE IN AN APARTMENT. SO MY QUESTION IS WHAT IS THE TOTAL AMOUNT AN APPLICANT CAN BE CHARGED AS SECURITY DEPOSIT

Hi Darlene..

You mention 'your manager'

Are you the owner or the tenant?

The amount you could charge MAY be controled

by the law in GA. or maybe not.. check the GA laws to be sure

If not then a owner may be able to ask for an amount they feel covers the risk for that person... and as long as all the parties agree it should be fine..

So if the person applying had a bad credit or did not pay on time for other credit items.. a owner may want more deposit on hand.

1. STOP SHOUTING.

2. From some quick Googling, it looks like there is NO legal limit for a S/D in Georgia. Therefore, it looks like, technically, any amount is legally acceptable -- although it likely has to be "reasonable" to a judge at some point. :)

(Except for Section-8 Housing Choice Voucher people -- I found some stuff that said, for GA, the maximum S/D that Housing authorities will allow is 2x the monthly rent.)

It is customary for one month security however the owner can charge 2 months without the court getting confused - remember you will pay interest on this amount when they move less the actual repair work. --66.72.xxx.xxx
