If they are still in a lease then you can't force them out. You are bound by that contract. Chances are you will have to pay them to leave voluntarily. Otherwise you sell the house with the tenants in it. --66.17.xxx.xx

He wants to move before it sells and has no one to take care of the property once he leaves. He believes if he left while it was occupied, the tennants would "trash" tha property and leave him with a greater loss than if he boarded it up so to speak until it sells :( --4.229.xxx.xxx

Kat, if you're serious about removing the tenants then give them a 30 day notice unless they have a lease, then it is a different story.

Go to the court house and talk to the clerks where you file eviction, they know everything.

Thanks for the info. My dad is the property owner and it's in Jackson. I live in MI or I would be on the train lol. I think he did say she was now MTM so I guess that's what he'll have to do. Thanks again! --4.229.xxx.xxx

I gave my tenants written notice that I was selling the property and that they would be given a 24 notice before showing. They moved out without notice. I didn't care because they were horrible tenants and we were ready to start eviction of violations (no lawn maintenance, garbage in the yard, flooding the house and not notifying us, etc.) --172.162.xxx.xxx
