State Specific Question About: WISCONSIN (WI)
I have a tenant that had his job has change (income is less)and he has stated to me in person and in a written letter that he needs to break his lease (going on his 4th month). He is paid up through the end of the month (term is 24th to the 24th each month).
Since the notice was given the phone number I have for him is a "non-working number" all numbers on his application are now "non-working". He isn't home much if at all (lives across the road from me)his electric & gas have been shut off for the past month now for nonpayment.
He has told me before it is okay for me to enter when he's not home to patch the walls, this was verbal.
I have posted letters on his front and back door about this & needing him to call me.
My question is how much notice do I need to give to show the place? How do I give notice if I can't find him? --24.211.xx.xxx |

You still need to serve the 24hr notice, unless she/he actually answers the door to let you in, if she/he came home while you were there and something is missing you will be blamed and being the defendant is much harder than the plaintiff. After you post and get in look for the keys on the kitchen countertop and all the good stuff gone to make it easier for you to repair and decorate. --99.147.xx.xx |

Yep I called the emergency numbers and personal refs. and got no where.
A women did call me back and gave me a new number. I also told her to tell him to call me since I am letting him out of his lease, we need to work together. His stuff is still in the place, you can see a lamp from the front window (blinds are open) and there is still items in garage(can see them through the windows).
His new job is in Chicago IL.
He did tell me he'd be out Nov. 1st (again that was verbal).
I guess I'll just have to wait n see. I'd like to get someone in before Jan. 2010 the winters and not the greatest time to find renters. --24.211.xx.xxx |

It's not to patch the walls it's to show the unit so I can get it rented for December I'd hate to lose out on rent since I am trying to help him here, (letting him out of his lease, I help him he helps me). He has a one year lease. --24.211.xx.xxx |

You may see action today. Keep your eye peeled and help this tenant to get completely out of your rental. It's to your benefit. Charge him for your clean up time. He is employed in Chicago so he is collectible. Good luck!

I believe per wisconsin law, you must give a 12 hour notice. see the wisconsin way or Chapter ATCP 134 - RESIDENTIAL RENTAL PRACTICES.
other wisconsin landlords - correct me if i'm wrong...

This is tough - but you gotta protect yourself ehre. Play it by the book. Evict!
With a judgment, you have a chance to collect... You would need his written authorization to put his stuff into storage. And the 1st is past - he is stealing from you and hurting you financially by his actions.
Can you read his mind? Can you grab his junk and store it (all in the garage, for starters?
Nah - and you might be accused later on.

He is paid up through November. He did call and left me a message on my phone stating he'd probably be out this coming weekend. He said I can show it anytime.
