State Specific Question About: WEST VIRGINIA (WV) I have a tent who is a month to month tent I stated this clearly in a written agreement. The tent has a boyfriend who first name only was put on the paper but, the original tent has been arrested and her boyfriend is not staying at the place he is just coming up every 4-7 days to check on the place. They have not paid me the rent for this month which was due on the 15th also i just found out they have had the electricity shut-off for past 2-months and actually tried to illegally hook it up and got caught. I gave them a notice to pay all rent and late fees by the 30th or move out. Is that enough notice to make them move? Moreover, did they violate enough rules by not providing electricity enough to get them out. I want them to move.

Erica, First off you need to take your whole name, if that is what I am seeing, off any post here. Tenants can use a computer also and you don't want them reading your thoughts and the advice you are given.

Second, if you want to know if the notice you gave is OK then you need to get familiar with WVA's LL laws. You can do that by clicking on "Landlord/Tenant State Laws" that is in blue right under the motor boat above. You need to find out if what you have done meets the requirements for your state. If it doesn't then fix it in jig time. You seem to have people who are going to try and ride you just as long as they can. You may also find that by having the electricity cut off they have abandoned the property or that you may assume that they have.

In addition to what Mac said about going to court for non payment of rent, you should also follow your local laws regarding abandonment, the utility problem will help you if you can get copies of the tampering report/s, get rested up so you can empty out the unit - clean and rerent before the winter weather comes along, take a lot of pictures of damaged rooms for second action which is the money recovery, the first thing is to get the unit back legally and change the locks, all the locks. --76.241.xxx.xxx

if no rent i start eviction on the 5thy and think u should too if your state lets u.if u havent evicted get a landlord tenant atty.maybe someone here has a name or u can get with a local landlord group or yellow pages or u have a friend in the biz who can help. --208.58.x.xx
