State Specific Question About: NEW HAMPSHIRE (NH)

Rent is due the 1st, late by the 4th. My tenant seems to think she can pay whatever, whenever she wants lately. For June rent, I received partial payments thru to July 1. She finishes paying on the 1st day of the next month and then excludes the late fee! July comes around & I gave her a Demand & Evict on the 5th. This is the 4th Demand & Evict within the past 13 months. Went to the court yesterday (14th) & got papers for writ & brought them to the sheriff. Today I receive a check for partial payment towards July payment! So now I have court fee for paperwork and sheriff's charge for service.

Question: Should I just go ahead and evict on the fact that she did not pay within the 7 days? And also that this is her 3rd Demand & Evict within a year? I'm just fed up with her games. She's been there for 3 years but it's time for her to go! Thanks for the advice. --65.175.xxx.xx

Don't know about your state, but I went thru this last year with a long term tenant.

Just get rid of them, while the weather is still good and you can re-rent. It's a trend, now. Seems once they start down this path, there is no turning back. --69.155.xx.xxx

I would not accept any payments from her period. If you do then the whole process starts over. The cost and all you have done so far...

YEP, of course after putting up with them, they left with no notice and left me a dumpster full of stuff! AND had the util off and left hamburger in the freezer.

I did get all the money from them, tho, so it has a happy ending.

That's why I say just get em out now.

I think yo could accept the money against previous bills and fees.

Call a Lawyer, and ask.

Attorneys can also put the money in an escrow fund against fees.

Accept payment if it is sufficent, the hand them a new notice for the past due amount. I deliever a 3 day notice on the 4th day of the month. If they do a partial, I decide if I want to accept, depending on the tenant, then hand them a new notice for the past due amount. My lease also states that past due fees are paid first and then rent due. Seems if she has done this a number of times, why would she change her behavior if she can get away with it every month? Kick her to curb and be done.
