State Specific Question About: WISCONSIN (WI)

Can I file for eviction even though tenant gave 60 days notice and court date is after they move out? date is dec 1 and they are moving nov 27...the reason for eviction is they said use $800 security deposit and $50 check they sent to equal the $850 for rent for nov.

IF they actually move out on 11/27 and IF the place isn't trashed... you could er uhm rationalize things that you got out of it ok.

But don't cancel the court date ;)

you can call off the court date after they give up possession...

assuming that happens..., i'd then get the place fixed up and send them an accounting of rent due, fix up costs minus SD, and bill them for the difference... in that accounting let them know you'll take them to small claims if not paid and/or a payout aggrement is not met in 30 days... if you say your gonna do it though...do it. --75.181.xxx.xxx
