State Specific Question About: WISCONSIN (WI)
A tenant's security deposit was mailed back to them at their last known address within the 21 days. That was on 10/10/08. Tenant has not received check and it has not been cashed at the bank. We are assuming that it is lost in the mail. Who's responsibility is it to pay the $25.00 stop payment fee on this so we can issue another check? Our checks have on them void in 90 days. Do we wait for the 90 days to issue another check?

I would not trust the bank to void them after 90 days. I would put a stop payment on the check.
Not saying they would. But if the tenant received both of the checks they could try to deposit both. Cash both. It's your money you decide if it is worth it to you to stop payment or not.
Do as posted above. Confirm the new address first.

I guess I gotta ask was it mailed overseas to someone who became a scammer? Stop payment and get a copy of that from the bank, mail certified, 20 days later mail replacement check certified mail, you must cover yourself and if they want to go to court, you have documentation before they can get a court date, so space them apart but do it cert mail. --99.160.xx.xx |

When you return a tenants security deposit you must do so within a specific time period. To verify that you have complied with the statute you would have sent the refund check with delivery confirmation, or by certified mail. If you did, then you would have proof of mailing, as well as the ability to trace the missing letter. If you didn't.....why not? --71.196.xx.xxx |
