State Specific Question About: WISCONSIN (WI)

My tenant gave 60 days notice and broke their lease in the meantime called HA for repairs. Well,now I have a whole lot of repairs to make and have to disclose it to possible new tenants. Can I still charge the old tenant monthly rent payment until repairs are made and I re rent the property since they are the ones that called HA? --24.183.x.xx

HA - Housing Authority?

Your departing tenant was on Section 8 and the HA did an inspection that disclosed a number of things the HA wanted fixed? Is that the issue?

If so, then NO. When the tenant departs (as long as all lease provisions were followed), then the HA will no longer pay.

As far as the next tenant is concerned, if they aren't on S8, I would just fix the major items and skip the minor stuff.

I wouldn't disclose anything relating the the HA inspection to the new tenant. --76.24.xx.xxx

Sorry I will be more clear...not Sec8...The tenant called Housing Authority and all the fixes are major and by WI law I have to disclose the information to a new tenant. Housing Authority will be back out to make sure all repairs are done. My question is can I still charge the old tenant the monthly rent until repairs are done and I am able to re rent the house? The tenant gave 60 days notice and still had 6 months left on the lease. So, I put a sign in the yard and have the ad on Criagslist. Thank you ahead of time. --24.183.x.xx

If you fix the problems within the specified time frame, then yes I beleive they must pay the rent. housing violations do not automatically mean the house is unlivable and there fore the lease may be broken. There must be a process. I would make friends quick at the HA, be super cooperative , and fix whatever it is. IF you can tell us what the problems are maybe we can help with inexpensive fixes. --69.118.xx.xx

The tenant should have the right to break the lease after they allowed a reasonable amount of time for you to fix the violations. As long as none are dangerous.

But if you have a lot of major problems you should have known about then that will not sit well with a judge.

And it sounds like you do not plan on fixing the problems but just disclosing them.

All the windows need glazing or replaced alot of cracked windows,sewer backed up so all flooring in the basement has to be replaced,roof,outlet in floor needs to be in baseboard,light socket that got water has to be fixed,outside light fixture needs to be replaced, back door lock or door, mirror sliding closet doors need to be replaced mirror broke, shower surround has to be re done and flooring etc. They are pretty major fixes and they said I qualify for a low interest loan through city to get them fixed. I plan on and have to fix them. This is all stuff I knew would need to be fixed I rented it that way. Planned on fixing some of it when the tenants moved out, just not all at once. --24.183.x.xx
