I had a tenant give me a rent check in Sept. 07. I never cashed the check (accident on my part) and I'd like to do so one year later. The tenant was on a lease in Sept. 07 but no longer on a lease (living there month to month; and has paid for Sept. 08 already).

I'd like to call the tenant and let her know I plan to cash the check or ask her to write a new check (note the check states it expires in 180 days). But I'm worried she might balk- do I have recourse for the rent even after a year (

If you accepted it as payment (which you did) and it's expired you are on her good graces if she wants to write you another check or not.

That said, if she didn't, I'd seriously consider wanting to continue to rent to her. Maybe a 30-day notice would loosen her check writing hand. --204.80.xxx.xx

Cashing a year old rent check is likely to throw her finances into an absolute tizzy. Most of my renters couldn't come up with 2 months worth of rent in one month. Impossible. If it were me, I would suck it up and leave sleeping dogs lay. --70.196.xxx.xxx

It is my experience that checks are no longer valid after 180 days. It would not be cashed by the bank.

If she chooses not to write you a new one you are out of luck though she still owes you the money. Since you didn't cash the check her account could be considered in arrears wouldn't it? --65.12.xxx.xxx

I'm sure the tenant realized that you never cashed the check as when they reconciled their bank statement they saw the check was outstanding and it remained so with every subsequent bank statement. So they kept mum instead of leting you know you hadn't cashed it. They knew you received it because you were not asking for the rent payment.

So now cash it!! If the bank won't cash it ask the tenants to issue you a new check.

If they don't or won't - well isn't it about time for that annual rent increase? --72.200.xxx.xxx

I just did this on a check dated from last year from our coin-op laundry leasing service. Check was going on a year old, found it in a pile of old paperwork. The leasing company told me to cash it as a deposit to my account, not try to get cash for it at my bank. It went through as a deposit A-OK.

I'd say talk to the tenant first to make sure they have funds, then cash as a deposit. The rent was never received by you for that month last year and you have the check in hand to prove it. You are owed. --71.63.xxx.xxx
