State Specific Question About: NEW HAMPSHIRE (NH)

What am I legally able to do with PERSONAL PROPERTY when my tenant has vacated the house he was renting? He was 4months behind. I served the notice to quit and demand for rent papers mid july.

In Maine we are obligated to store it, usually a paid type secure thing. I forget what the details are thankfully because it has been so long since it happened.

VII. Other than residential real estate under RSA 540-B, a landlord shall maintain and exercise reasonable care in the storage of the personal property of a tenant who has vacated the premises, either voluntarily or by eviction, for a period of 28 days after the date upon which such tenant has vacated. During this period, the tenant shall be allowed to recover personal property without payment of rent or storage fees. After the 28-day limit has expired, such personal property may be disposed of by the landlord without notice to the tenant. --75.68.xxx.xxx

Abandonment is very state specific. Hopefully a knowledgeable NH LL will give you some info on the local laws & customs. Does your rental agreement have any clauses regarding abandoning the unit?

Do you have a court order returning the property to you? Has the tenant returned the keys to you? have they discontinued their utilities?

In the real world of LLing I would throw out any obvious trash & put the rest of the stuff in the garage or 1 room. This would enable me to start getting the rest of the place ready to rerent.

If you know where they have gone you might offer to drop off their "treasures".

Next time start the non payment eviction as soon as they are a few days late.

Wow, sounds like alot of work for a deadbeat.

As much as Ontario landlord/tenants laws are very tenant friendly, if they leave willingly or through eviction, anything they leave behind goes out to the curb (just did one of those).

If they are evicted by the sheriff, you have to give them 72 hours to pick up the stuff, if they don't come get it, out to the curb. --70.24.xx.xxx

THx for your replies. And yes you are right, NH Sailmaker....I did find the RSA yesterday but you reinforced it.

So I am going to mail them a leter advising them if they want their stuff,

* to retreive it by Sun 7th......

*their lease "technically" was up Aug 3(they hadn't been paying)

*the notice to quit and demand for rent were left for them on July 7.

One more thing. They left a CAT there with its bag of food. (They were even not suppose to have animals)

and coincidentally, i had an eviction last month and today is day 29!!! so i'm having a very big yard sale. the tenant never came back for anything!!! --166.68.xxx.xxx
