State Specific Question About: ALABAMA (AL)

I hired a lawyer for my first eviction. I learned that it take too long to evict. Went to the lawter in April when the tenant ignored the lease termination in March. (termaination should have been eviction for late payment)Anyway, 3 days ago I get a call from my lawyer stating the the tentant called him stating the sheriffs office left a note on her door that said they would be putting her out at 0830 that day it was 1145 when she called him and they had not gotten there yet. She wanted the lawyer to arrange it so they would not come because she would have help to move out in the pm when her family got off work.He said he was calling to let me know I needed to check tomorrow and see if they are gone.

My son drove be that evening and sure enough there was a truck helping her move.

That was tuesday on Thursday I called the sheriffs office to see when I could pick up my keys and was told that I would be called?

This evening I get home and there is a message from the lawyer stating the sheriff had sat her out and delivered the keys to him. He was gone for the day.

I drove to the property with camera in hand. Thre was a small pile of left behind items, no funiture or heavy items.

Looks like they warned them hoping they would move and then they could come behind them and sit out 2 bags worth of garbage and charge me for it. They left another 2 bags of garbage for me to take out inside. To top it all off the door was left wide open.

Why would that give her a date and not follow thru and then charge me and not lock the house up when they had the keys?

I'm pretty upset, but I got the house back. I will cost a few hundred to get it ready for another tentant.

The new law is not much help to me. The sheriffs dept. informed me it could take up to a month to evict after they received the case. ughh

People don't care anymore about doing their jobs properly especially in that kind of second tier law enforcement. I find that some fireman are a little strange also. When an ambulance crew came for my mother there were six men in her room and none would assist her. I had her off the bed and dressed and no one would get her on a stretcher to get her down the stairs or into the wheel chair. There was a chair lift on the stairs and one bozo wanted to call the firemen to rip it out so they could get a stretcher down. It was a $6,000 chair lift. I just quietly lifted her and moved her from the chair to the wheelchair then over to the chair lift, with a chair change on the landing, and down to the first floor while six men watched. She weighed 100 pounds if that and I weigh 125. Six brawny men watched that. Shame Shame Shame on your sherrifs also. --76.99.xxx.xxx

This is a tenant post IMO. You don't evict for late rent. You evict for Non-payment of rent.

The Sheriff dept won't deliver the keys to the lawyer. Someone has to be at the property to supply the keys to the dwelling for the sheriff and also have a locksmith with them or a locksmith that will show up right away. The Owner/Landlord or a rep of the owner who is authorized, must sign the writ.

The sheriff department does not charge for the setting out of tenants possessions.

There is a fee that is paid PRIOR way prior

for securing the property.

The sheriff is not going to listen to any story the tenant has to stall for more time.

This is a court order. It will be carried out. According to set procedure.

The sheriff's that do evictions/lock outs.

Do this day after day, month after month.

They know the process.
