State Specific Question About: NEW HAMPSHIRE (NH)

Does anyone have a clause in their agreement to keep areas clear in case of fire? I have a two family home w/breezeway, garage & basement. We did some electrical work and we had to literally throw clothes off the stairway in order to get to the panels. The breezeway always has a bunch of stuff and the garage is currently housing a car up on jacks which has been there for a few months. Thanks for your input.

Hi Cheryl,

I do, its under Tenants Obligations, since most seem to check their Common Sense at the door.

Issue a Notice to Cure to both families (if your not one of them living there). Outline the areas that are to be kept clear due to fire hazard, the auto needs to be fixed or towed. All with in a specified time period then be prepared to back it up. Because they, the tenants will test you.

We had same problem with junk piling up in the basement all around the furnace and water heater. I sent this notice and asked them to clean it up or it would all be thrown away due to fire hazard. Boy, is that basement looking GOOD and tidy.

You can always say the Fire Dept. contacted you as a courtesy to the concern about the "fire hazard" area and please clean it.

My MTM agreement has the clause stating tenant must follow all federal, state and local laws and ordinances. It is a catch all clause that has helprd me out with many situations that could not be covered specifically within the lease.

In this case, I would give a written notice to cure, as required by my state's LL/T Laws, quoting the ordinance.

they have no right to have things in the common areas and i ask them to remove them if it gets cluttered.on front porch i let a couple of chairs and thats about it.some guys will put their crap all over the common areas creating fire hazard conditions .iu have to politely step on them. --208.58.x.xx
