State Specific Question About: MINNESOTA (MN) MN renter began bouncing checks 4 months into a 12 month lease with no communications to me prior. After 2 more months of late payments, we terminated his lease early because he agreed it would be impossible to continue making payments, with him being late again on the next/final 2 months of payments. Having shelled out big money to hire someone to find a new tenant, I wanted to make sure I had all damages covered (I live out of country). I sent him his deposit, minus damages, but it was communicated 7 days after the 21 day statute. Now he says I am going to be taken to small claims courts for double the initial deposit plus a $200 fine. In the lease, it states that I have no deadline for requesting damages caused by early termination. Which overides? The lease or the tenant statute?

It may be less important of the date you mailed the deposit accounting, but rather the date that you consider that the tenant ACTUALLY vacated the unit. ( items left inside unit, keys returned personally to LL and not just left somewhere, written receipt from LL acknowledging tenant being out, etc. You can defend the actual date of vacating if the tenant can't prove he complied with your lease terms regarding vacating for deposit return. --71.196.xx.xxx |
