State Specific Question About: NEVADA (NV)

The tenant caused a kitchen grease fire. Our insurance want them to move out durning the clean up. Who is responsible for paying for the tenant's temporary move out expense? Is it legal for me to have them pay the deductible, since it was their negligence? How much advance notice must be given regarding the move out? --208.106.xx.xx

They do not have Renter's insurance. They have continued to live in the home without the use of the kitchen. However, after testing, the house tested "hot" for Aspect. --208.106.xx.xx

You need to read your rental agreement. See the section below that I have that addresses what will happen if the property becomes untenable (which yours is - homes must have a functioning kitchen). Their agreement is terminated and they need to vacate. If they don't then either call code enforcement who will basically "condem" the unit or post a 3-Day Notice to Cure and get them out through the courts. Don't wait - the longer they are there without a kitchen the more amunition they have when this goes to court.

DESTRUCTION OF PREMISES: In the event the leased premises shall be destroyed or rendered totally untenable by fire, windstorm, flooding or an other cause beyond the control of Landlord, then this rental agreement shall cease and terminate as of the date of such destruction, and the rent shall then be accounted for between Landlord and Tenant up to the time of such damage or destruction of said premises. However, in the event that the tenant or the tenant’s visitors, guests, invitees or family member is responsible for the damages and/or destruction, the tenant will nevertheless be responsible for any and all damages and repair costs associated therewith. --66.60.xxx.xxx

Did you receive a final report from the fire dept. identifying the origin and cause of the fire? ....If the tenants insist on staying, file a law suit for the damages and any loss of income. Most cities want them out for health and safety reasons, the renters insurance takes care of them - the property insurance takes care of you. If they are without insurance your company will probably follow them to work for garnishment, regardless of insurance situation they need to pack - quick, advise them your insurance company will be changing the locks and the keys will go to the contractors who will be living here until all is well with the insurance and city insectors. --99.128.xx.xx

I would evict them ASAP!! If you do not and they come down with health issues or become injured as a result of the damage, you will be facing more headaches and could be found liable. You are not responsible for paying for the move or the tenants damaged property. I would not ask them pay your deductible but doubt it is illegal. Your insuance carrier will subrogate against the tenant if they are found to be liable for the fire damage. They will recover your deductible and persue the amount of the settlement via a judgement and ensuing garnishment etc. You should insist that your adjuster/carrier hire a cause and origin expert to determine the exact cause of the fire (even if the fire department has done this). This will be needed for the carrier to sucessfully pursue the tenant. Even if they do not have a dime, at least a judgement will be placed and they will be forced to pay something at some point and their credit will be ruined. --24.106.xx.x

In Los Angeles, a tenant is responsible for their own temporaty housing costs while you fix up their unit. The catch, you can not charge them rent during the time their not in your unit. --207.200.xxx.xxx
