Most cities want them out for health and safety reasons, the renters insurance takes care of them - the property insurance takes care of you. I would evict them ASAP!! If you do not and they come down with health issues or become injured as a result of the damage, you will be facing more headaches and could be found liable. You are not responsible for paying for the move or the tenants damaged property. I would not ask them pay your deductible but doubt it is illegal. Your insuance carrier will subrogate against the tenant if they are found to be liable for the fire damage. They will recover your deductible and persue the amount of the settlement via a judgement and ensuing garnishment etc. You should insist that your adjuster/carrier hire a cause and origin expert to determine the exact cause of the fire (even if the fire department has done this). This will be needed for the carrier to sucessfully pursue the tenant.
