State Specific Question About: ALABAMA (AL)

Our tenant vacated the premises without paying rent for 4 months due to one personal reason after another. Final rent was a bounced check written in Dec 2007 but didn't bounce until February 2008. Would like to list the couples names on a bad tenant list.

Marlene - you cannot listen to a tenant's "personal reasons" and let them get 4 months behind on the rent. If you do that, you are not cut out for this business. THERE ARE NO EXCUSES FOR NOT PAYING THE RENT. If they don't pay the rent, get them out immediately, otherwise (as you know) you are in for heartache and lost revenue. Bottom line is: most people who rent are living hand-to-mouth (hey, some of us are, as well!) - if they get more that one month behind, where in the world are they going to get the money to catch up - from the lottery? --68.211.xx.xxx

One other thing - that bounced check does give you some leverage to get some money out of them, but you have to act quickly - like now - today - this hour. I am also curious what happened between Dec and Feb - if you failed to deposit the check in a timely manner, then you may have given up some of your rights to collect it. There should only be about a one week turnaround on a bad check. But maybe your tenant's bank is on Mars.

BTW, this is one reason it is important to have a driver's license (or as we call it here in GA - a drivin' lisend) number on file - if you end up getting a bad check warrant and don't get an immediate resolution, the criminal's DL will go into the state's wanted computer and when (yes, most of our tenants seem to go from one traffic ticket to the next, don't they?) they get pulled over, they will be cuffed and taken to jail until the check is made good.

And Marlene, if you do get that bad check warrant, and the tenant calls you and wants to make a deal (ie, give you less than what they owe you in return for dropping the case), please don't do it.

get a judgment in scc and agencies pick it up usually.get credit report in several moths to see if they did.if tenant is working u can pull them into scc and get maybe 50 a month.u have to go to court a few times.if agencies dont get it u can put it on "services "above and "reporting resident debts" --208.58.x.xx
