State Specific Question About: ARKANSAS (AR)

Hello, My tenant left owing rent and w/o required 30 days notice. I am wondering how much rent he owes. Specifics: He signed a mtm lease that starts on the first of the month. He told me he couldn’t pay Oct rent because he was going in for an operation, so wasn’t working. He said that his mom would pay for Oct & Nov rent on Nov 1 st, so I let it slide (she also called, but I don’t know her at all). But then he refused to communicate with me and skipped out about Nov 15 (I am currently looking for a new tenant – not the best time of year for that, is it). Rent is $500/mo. So, does he owe 2 months (Oct & Nov) or 3 months, since notice would have put him in the middle of Dec, since it’s month to month?

u shouldnt have believed him when he said mother would pay 2 months on nov 1.do not bekieve what tenantstell u.i would have started eviction when 4 days late.i think u should have done that if your state lets u.i would say he owes u 3 months --208.58.x.xx

Yes 3 months Billy Button is on the mark.

...HOWEVER....

you may owe him if you didn't do a security deposit accounting? Yes even if you didn't have a security deposit for this tenant. Yes even more so if you did have one and just kept it without doing the required security deposit accounting. Depends on your state of AR land lord tenant law and what has transpired here..

So tell us what happened. We can help you figure out what to do.

Hello Josh. Thenk you. I inherited the tenant when I bought the property in Sep. Reg the deposit; He is definately gone. Didn't leave a forwarding address or the keys (new locks now). I think I followed proper procedure...I mailed a security deposit notice within 30 days of him being gone, but since I knew he wasn't there, I put in red letters, "Do not forward Address Correction Requested". US Postal Service told me it would not be delivered but sent back to me with a forwarding address if there is one, and it could take at least 14 business days to get it back. Haven't gotten it back yet with the holidays, must be delayed? I made copies of the signed notice and the envelope. --69.107.xx.xx

First time. It's a duplex. I'm also a long distance LL. Quite a learning experience. In the future I may hire a property management co. It's just that I read one co's contract and it's pretty flimsy. They didn't provide me with a copy of the lease they use, or if they run into legal problems, how they would specifically handle the situation: would they try to collect unpaid rent? Go to small claims? What is their screening process. Their contract left too many unanswered questions.

By the way, in contrast, my other tenant is great. No problems at all. --69.107.xx.xx
