State Specific Question About: TENNESSEE (TN)

Hello, I am an out of State Landlord. I have a property in TN. I am new at this landlord ordeal. The individual in my property has bounced a check twice. This was for partial rent. They don't have a house phone and they say there cell phone minutes are gone. They only contact me or the MGMT co. by text message or email. I have told them about the bounced check once. They sent another bad check. Then I told them I only wanted a money order. They said they sent one. 2 weeks went by.. nothing. I notified them about the cure or quit. That has gone by. I told them I would turn them into the authorites for bouncing these checks. Is there anything else I can do.

Do as tyler states and fired the management company. Screen the next tenants better. I'm sure your current low-life tenants have a history of eviction as well as a very bad credit history.

first and foremost--never accept a check to replace a bounced check-- cash, money order or certified funds only.

Yes there is a spicific way to have a check made good or the writter of the check locked up AND you better know what your doing before proceeding.

Our county here in GA has a sheet and schedule that MUST be adhered too if you want a warrent issued.

GET an attorney who can handle the Bad check and start the disposessary process.

FYI-- there are some instances where you can't get a warrent for a bad check--like a check that was post dated. --74.184.xxx.xx

You appear to have attempted landlording on the cheap and only hired a property manager to put a tenant in place rather than to manage the property for you.

If your mgmt company is not collecting the rent, then they should be so that they can deal directly with NSF checks and handle appropriately either via civil court or criminal complaint.

I'm suggesting the communication limitation is yours if you can only text or e-mail since every property management company I have known in 40+ years has a phone # - several in fact including FAX #s. Most now have websites.

Serving the tenant with appropriate pay or quit with appropriate fees is the way to go either through the PM or an attorney. --67.142.xxx.xx

The MGMT. co will handle the legal proceedings for me. I am asking for my own clarification which has been more than helpful. The MGMT co. is having the same problem only text messages and dealing with same sorry excuses of no cell phone minutes. I have been doing a lot of this myself so that I could learn as this is my first year being a landlord. Learning experience isn't the word. --70.182.x.xxx

if u are an out of state landlord i think u should probably sell the property when u get a chnce.i dont think we should own over 30 minute drive from our houses altho some here are successful at it.the average landlord should not do this in my opinion.when they are 4 days late we start eviction and think u should too if your state allows it.did u screen these bums before renting to them?good luck.read and ask questions. --208.58.x.xx

It is a felony offense of write a bad check in Tn. File for a warrant on them, it costs you nothing. Write the tenant a certified letter stating their costs to date plus the bad check fee if it is in your lease. Enclose an eviction notice.

Shannon - Mgmt co needs to start serving proper notice(s) and NOT waiting on you to learn what must be done. They should know what to do and should have attorney or proper legal procedures to follow through and they should be doing it rather than you reasearching what they can already/should be doing. You are wasting $$$ and time since we are obviously talking about Dec rent and it is now Jan so you may well be 2 months behind.

The 2X check is no longer negotiable through their bank so immediate EVICTION is in order....if there was a genuine misunderstanding, that can ALL be straightened out while the court date approaches.

Again, adivse mgmt to proceed with eviction and you play learning catch-up while the clock is ticking and you have a court date.

I'm unfamiliar with TN law, but I'd refrain from getting the tenant arrested, because that could delay the eviction.

Your main goal should be getting them out, cleaning up and finding suitable tenants. You can attempt to press charges later. --71.204.xx.xxx
