Hi

We brought our first home in march and the old owners mentioned they will need to continue staying there until they have their new home ready.Lease was signed till july.

Now they are not willing to move so we had asked our real estate transactions lawyer send them reminder notice 60 days ahead that we cant extend the lease after july. We send a follow up 30 day notice on July 1 stating the same.

Now they have send an email stating that we are harassing them and will take us to court. Sending a gentle reminder that we wont be in a position to extend a lease is harsement ?

We are staying in a rented property and our lease is also ending by july .This was an arrangement so they can move when their place is ready by July When they were doing the closing they also have their word that in case anything happen they have their family home to move ,now they choose not to move and in turn threatening us. Let us know sending a reminder through proper channel that we are not in position to continue lease is harsement,?

Back in the early 1980's I purchased my 7th rental home. The seller asked if he would could stay an extra 2 weeks because the condo he was purchasing needed more time to close. So we wrote up a temporary lease agreement, giving him a maximum of 30 days.

Even with my years of experience I was duped. The old owner now demanded an extra $10,000 because he had sold his home too cheap!

When I alerted him that I was going to file an eviction, he filed a false police report that I broke into his home and stolen $5,000 in cash.

When the police showed up on my doorstep to arrest me, I had already filed for an eviction and had the paperwork to show the police. The detective at the station told the police not to arrest me since I had proof the seller wanted Ten Thousand Dollars or he wasn't going to move. I also had a lease....

So if you talked with your tenant/old owner and he's not going to budge, you'll need to evict. The only advice I'd give is to arrange an inspection and take pictures of the condition before you serve him with the eviction so you can prove damages.... --47.155.xx.xxx

Well if they are actually buying another place at least you'll have something to have a lien put on.

Is your "real estate transactions lawyer" the person who drew up the rental agreement & the one who is now handling these notices? If so unless they are actually experience in LL / Tenant matters I highly recommend that you get a lawyer who regularly represents LLs & who is very familiar with PA LL / Tenant laws. --71.174.xxx.xx

Time to put away the nice side of dealing with them.They have shown their true character. Lowlife types always say this. Time to bring out your not nice side.

Immediately file on them. Notify police of situation because they may file suit against you.

Since its your first one, put a lawyer who specializes in evictions on it. Follow advice above regarding pictures of condition of possible. Follow through and get a judgement and lien on their new place and pursue collections. Get every cent of unpaid rent, damages, lawyer and court fees.

Be aware that the court may not allow evictions at this time.

Make alternate plans for yourself so you don't get caught without a place.

If you had a lawyer, did they put in clauses for double rent for holdover? Did they demand that seller leave a substantial ($5000+ or more) amount in escrow to guarantee performance)? If they did, good! Immediately file on the performance clause. If not, ask why they did not do this.

Now, to make sure this never happens again, keep visiting here and ask before doing stuff. --24.180.xx.xx

Ya really very much stressful situation. We have put every single money we saved and got this new house now with attroney and court it going to end up in many many dollars which we dont have or cant afford but we have decided that people cant cheat us and we r going to do what if takes to get us a judgement.

We hired a lawyer who was recommended to us by our real estate agent.

Our attroney was also in the email where the tenants mentioned he is going to file case against us for harassment.we spoke with our attroney and he said ignore this and when his attroney send anything we will deal with it these are just threatening email. But I am thinking shouldn't our attroney reply to that email and say this was just a 30 day notice by state of law as a reminder that lease is going to expire?

Attroney just said ignore which make me nervous will it turn bad to us prove that if we don't respond to the his email ?

This is so stressful situation

when you say their new home ready-- u mean to close onnew home?

I would remind these "people" that you are filing the dispo and will slap a lien on the proeprty they are trying to close on. Try closing with a cloud on the title.

If you have mechanic liens youmay also mention that you will cloud that closing by slapping a mechanic lien on it-- just to muddy the closing.

sometimes you have to get dirty when dealing with dirt!!!!!

WHAT type atty you get? a RE atty who closes proeprty? or a real atty who knows LL/tenant issues? Big difference. --99.103.xxx.xxx

fire an attorney who sends "a reminder" unless your lease contains a waiver of notice clause. If so, file next Friday when the courts open back up (doublecheck - I think the 10th is the first day). If no waiver, get the 30 day notice out today and file on day 31.

I don't get it although it's moot at this point. The sellers "mentioned they needed to stay there". Why did you agree with that when you are in a rented place? --72.70.xxx.xxx

Yes, I also would get a new lawyer.

Current one maybe fine for a simple closing. But not aggressive or experienced enough to deal with a real problem.

Sending them a notice at at least threaten to sue for moving expenses and hotel cost.

yes, now that you are saying they have another 23 days, you can do nothing.

how do you know they are not willing to move at the end of the month? Not that it matters but are they building a new house? Did they say their new home isn't ready yet? As you know, the governor stopped construction for about six weeks so they would be running late.

I'd ignore the cry of harassment but I'd have my lawyer ready to go on July 28 if they are not going to be out.

asking us to drop our kid to that district school for a month.Yes I understand the construction was stopped. But problem is our lease/school/work and our child is asthmatic and allergic to carpets. The place we live now bedroom are carpeted we make her sleep in the hall n have also need to increase inhaler. With the covid it even scary for us with her asthma. we moved in from different location in the middle n had no house available the only one in this close by locality which we can afford and with just atleast the hall wooden was the rented place that we are on.

To add on I had to go to work driving 2 hours and now dropping kid to school from one district to another and then going to work is all going to be a painful.

The deal we had we had clearly told him we cant do after July.

We looked lot of options and in our budget we got a fully wooden house which was this home and we brought it. I can't see my daughter suffer anymore.

With the covid situation all we could do is wen we closed they had still not fixed the damages the service inspector found it was related to plumbing since it was covid we told him it's fine once u move out in july please take care of it.

You wont believe we have been so stupid and trusted people we closed the deal and now just the house in our name no keys we did not take formal pocession check before closing. we dont even know if the house is as in condition as how we saw them before entering into contract. there are several very good landlord associations in Pennsylvania. Find the one that would encompass your county (or a close one) and find out who the majority of landlords use. Hire that attorney, THIS WEEK, so that on July 28 he/she can file for you. This is WAY above your abilities to handle yourself.

I'm all about personal responsibility for your actions and accepting the consequences thereof; however, it seems to me from reading this that your original attorney didn't do a very good job. Don't hire this one again. You absolutely should have received keys. The plumbing issue should have been fixed or funds escrowed.

Finally, not to be cruel but your child's medical condition, school district nor your distance from work have no legal bearing on this.

Hire a lawyer THIS WEEK so you are ready on the 28th. Depending when school starts, you may be in the new property then. Check with your current landlord about a mnth to month lease for August and September. --72.70.xxx.xxx
