Tenant there a year, lease was going to end on June 30th. Always paid by the 7th. Lost her job due to Covid. Reminded me Govenor put hold on evictions for 60 days. No pay April, May and June but paid April's on June 1st. Sent me email saying she was leaving June 30 and once her unemployment was paid she would settle up with me but wanted to use one of the two month's security to pay May rent. For three weeks she has not contacted me or responds to my emails or calls. Other tenants say they have not seen her and family for 3 weeks. We had police do wellness check. No one answered. We went in and they left everything. It's like she got a lump sum check and just bounced. My attorney says we should go through an eviction but I was wondering what you guys would do.

Each time a tenant vanishes without a trace but leaves most of their stuff behind, at some point they will return to collect their belongings. If you remove so much as an unmatched pair of socks without the legal right issued by a court, be prepared to be sued in Small Claims Court.

One of my tenants did the same thing to me. When they returned to their apartment, their keys no longer worked. So they kicked in the door and found another family living there. When the police showed up the x-tenant claimed they went away on a vacation and when they returned, all of their valuable possessions went missing and the owner rented the unit out to "friends".

The police called me to show up at the station, this case was under investigation. I was being accused of steeling over $5,000 worth of my tenants stuff and doing an illegal eviction.

I had done a proper eviction. Then I documented the contents taking pictures. I had an auction then disposed of what ever didn't sell. I put the proceeds into escrow too.

The police closed the case and did not go after my x-tenant for lying, breaking down a door either.... --47.155.xx.xxx

It is not uncommon that tenants use the arrears to buy new furniture when they move into another rental unit. Small claims for arrears, damages and cleaning providing they work. No moving expense as there is new furniture in the new rental unit. --147.194.xxx.xx

If you can legitimately use abandonment clause, it will be a much faster way to regain control. However, You have communication with the tenants, so, unless she stated not coming back, you are in a shaky ground in that sense. You have documentation from her (via email) that she would be out June 30. Her lease expired. She's out. Sounds like she left behind some trash along with the keys she left on the counter.

Print the email. Document the trash/items and remove them to a storage unit and pay the first month's rent. Re-rent the unit. If she wants the trash she abandoned, she can pay the storage fees. That's the route I would take...

So just to answer a few questions. I reached out to her father and elder son. Had to leave messages and no call backs yet. She did not leave keys. They do not own a car so not sure if they were able to move stuff. Her phone has a message saying it is not taking calls right now. Tenant said this in her last communication....Hi Sharon, I did see that you called. We will be moving out by the end of the month as we had mentioned. We would like to use one month of the 2 months security deposit for our June rent. I am awaiting word from the state rep's office on the unemployment matter and hope to hear back soon. When I do and receive my back pay, I will contact you when we have mailed out rent for May as we are still within the 60 day grace period until months end. I added the portion of Governor Lamont's executive order below that explains my above statements.

For rent due in May 2020, landlords must grant a 60-day grace period for payment upon the request of tenants. Under this provision, a tenant must to notify the landlord that they have lost a job, lost hours, or otherwise lost revenue or faced significant increased expenses as a result of the COVID-19 pandemic.

If a tenant has a paid security deposit of more than one month’s rent, the tenant can apply all or part of that excess to April, May, or June rent. Under this provision, the tenant must notify the landlord that they have lost a job, lost hours, or otherwise lost revenue or faced significant increased expenses as a result of the COVID-19 pandemic.

In your first post you said she wanted to use part of SD to pay May's rent & in your last post it was to pay June's rent. Unless I'm not understanding something, according to your Governor she can use her 2 months SD to pay for May & June & since she already paid for April, as of now she only owes for July. If this is the case IMO you would be foolish to do anything other than follow your attorney's advice to proceed with a legal non payment eviction.

Unfortunately for you & a good many other LLs, our government has chosen to force us to subsidized non paying tenants whether we choose to or not. --71.174.xxx.xx

I have FL Abandonment steps listed/spelled out in my lease. Since you have her email, I would follow your state's abandonment to the letter of the law and document each and every step. I add the days it takes to work through all the steps to the unpaid rent

You can't use a notice from a tenant saying they will be out at the end of the month as proof that they are gone, even though all their stuff is still there.

You need the notice from the tenant that they are out and done and not coming back and they don't want anything that they have left.

Yes, there is food in frig, tp in bathroom and utilities are still on and I cant do anything until August 25th.

The post office does not have a forwarding. I called family members and no one calls me back. This really sucks. On the up side my eidl loan will probably help me. --32.213.xxx.xx
