So the wonderful city of San Diego just voted to extend the moratorium for no rent, no eviction until September 30th. That will make it 7 full months that Landlords will have been without a penny of rent from those who claim hardship, while still being forced to provide tenants with any utilities that were included in the lease or face fines and court actions against them. Can't kick anyone out unless it's for something 'dangerous to health and safety'. We are supposed to make 'payment plans' for after the moratorium is lifted, which at the current time, might get extended till the end of 2020. They then have at least 6 months to pay the missing rent. The chances of anyone actually paying the 'back rent' is slim to none. So my question is this: I have a tenant who has been here a year and is moving out at the end of July. He's paid up in full. I will need a few weeks (maybe more) to get the place in shape and re-rented. THEN what do I do? Should I take a chance that a new tenant will soon after claim hardship and not pay and just get free rent for however long the city decides? Or should I leave the rental empty till this is all over and save any headaches new tenants may bring? Or should I try to get someone who will be able to pay 3 months rent up front so I will have that no matter what happens? In this case, 3 months would be $5400.00. That's a lot to come up with all at once. I'm thinking about locking myself in the bathroom until it's all over.

Why not just sell it?

With the craziness they are unleashing on landlords, especially in Calif, they might extend this for another entire year or make it permanent. Also it looks like every day they invent even more crazy rules.

What's next? Will they forbid landlords to sell? Force them to rent to those who don't pay? Fine us if we let a house sit empty? Or worse? OH, wait, I believe they already proposed doing that!

It's time to be done with allowing people who would do this to us to continue. Unfortunately, our only remaining options in the face of this increasing desire to put constraints on landlords are either to vote them out or leave. Otherwise they will continue to pass more and more stuff like this and bankrupt us. I, for one, am not going to simply wait until I have no options left.

As sad as it seems, I think it's time to just sell and move our investments to a better place or a different type of investment, at least until this craziness stops, if it ever does.

I had a nightmare where communism took over, disguised as liberalism. All private property was confiscated. Landlords were arrested and imprisoned or sent to gulags. Only the gov't could own houses. The gov't assigned you a place to live. The gov't decided how big or how nice a house you could have. Landlords were done away with (That is not your house!, you didn't build that, you no longer have the right to own a house. You especially don't have the right to own more than one house because that would make the tenant into a slave, working and having to turn over their wages just got a roof over their head.) One of my tenants who hasn't paid a full month's rent because of the pandemic, continues to shop on Amazon. Packages arrive almost every day. I can see by the packaging thrown in the common apartment trash bins how expensive items these tenants keep on buying. Also they have delivered almost every day take out food.

With pictures, their original application listing bank account with high balances -- I guess I'll just take them to Small Claims Court and try to get a judgement that way. No need to evict..just collect. --47.155.xx.xxx

You could have a chat with the non payer and tell them how much they will owe and when this moratorium is over you will sue them for the full amount AND remove them AND their credit report will show that. Can you encourage them to leave quietly now and find some other place? Then sue them when it's allowed but meanwhile you will have someone that pays. I suggest sending rent bills that include the utilities agreed in the lease and repair costs like drain being jammed, for the first 3 months I added a line I waivered the late fees, but in your situation I would only do 3 months, then when the ban is lifted the tenant will have a large bill - take the 1 time payment plan, banks have payment plans not housing providers... --76.188.xxx.xxx

I saw on my state's website that if you send a notice of rent arrearage, that you must prominently display on the notice that it's not a notice to quit, they are not being evicted, and they do not have to leave their home and that an emergency law during the pandemic protects them from eviction. --66.30.xx.xx

I have urged LLs some time ago to switch all utilities to the Ts due to the risk of rent control. I have one T who is in arrears - he pays all utilities except trash and I have just cut his trash service to the bare minimum. Such a relief to not have to pay his hot water, electric, water, sewer bills while he doesn't pay, especially since I know he has the money to pay rent. Good luck not paying the water or electric companies. Any LL not getting the utilities out of his name asap after this moratorium is a fool. Ah yes, selling the rentals would be great, BUT it's impossible unless I want to move from my cute little Craftsman home I've been in for 42 years. My property happens to be 2/3 acre with THREE houses on it all in ONE parcel. Can't do a split because all the utilities (gas, water, electric, run from one source and go from my house(on street) to the other 2 behind me. Everything in intertwined because the original owner built the rentals behind him and linked everything to save on permits, etc. Done in 1951 with my house being 1944. I'd love to get rid of the rentals, but would have to undo all the connecting utilities, AND provide a permanent easement right beside my bedroom window (long driveway goes 300 feet back to the rentals and no other room on either side of me to section off a driveway for just them. I'm stuck. Can't afford to move either. Housing prices in San Diego are sky high, so are rentals. Fair rent for each of my 800 sq foot rentals is $1900.00 and I'm under that. The entire parcel with 3 houses is now valued at somewhere between 7 and 800k BUT little houses around here are selling (single on small lots) for $600k. Property taxes are around $4000. a year. I had an unsolicited offer last summer for guaranteed profit of $800k but moving just isn't sounding like what I really want to do. Terrible times. San Diego is not the place to invest unless you win the lottery or have inherited millions from your Aunt Bessie. I was a renter in this house for 20 years before the Landlord died and his wife sold me the entire property. Choice was buy or move out and then she would tear down all 3 houses and build condos. Offer price was awesome and I stayed. It's not all bad, one of my tenants has been here for 18 years now and not a bit of trouble. And until August of 2018 the other tenants had been here 30 years. Then it became a mess of doing my first eviction and now this Moratorium stuff. Still, I think the locking in the bathroom till it's over idea is sounding pretty good. --72.199.xx.xxx

I have a Craftsman triplex in North Park. Paid some dudes to trench a line to the rear units then installed PEX and plumbed in separate lines to each unit then paid the SD City Water to install 2 additional meters for $3k each at the curb. If you believe you can't do something, You are right. If you believe you can do something, you are right. Make your choice. I pay no water bills or hot water bills or trash or electric - I pay no utility bills whatever on this complex - so sweet! Thanks for the pep talk WL. I'll check into the city again for the cost of new meters for the 2 back houses. Last time I asked (when they installed sidewalks in our area) it was $12,000 PER meter not including running the lines. Lines are already in so it would be fairly simple to just split them off of my meter(only about 100 feet of piping x2). Maybe things have changed in price. Just raise your standards and look where employed. Could also ask for an additional guarantor if you rent to anyone until this is over.

Installed the SD City meters around 2009. Prices must have gone up. Such a relief to not get bloated water / sewer bills anymore from Ts running a neighborhood laundromat or whatever . . . When I switched over the billing, some Ts complained like crazy - these water bills are wrong! Can't be that high! I told them - I know exactly how your feel! Yup, WL, my 'first eviction' tenant moved in her CLOTHES and bedding before she actually moved in. She spent 2 weeks washing everything (my water bill). She was OCD clean. Helped when she moved out since the place was reallllly clean. Next tenant, current, adult daughter (who was supposed to stay just a bit) was having all her friends and cousins bring THEIR wash over. She sure was. Water bill doubled. Put an end to that with a warning. Not happening now and things are good except for Dad/Daughter had a fight over a new boyfriend and daughter won't speak to Dad for 3 months now. That's why he's moving out. Probably back to a one room in someone's house, so she can't follow. She hasn't paid a penny to him for 11 months of FREE stay. He's had it. She should be gone mid month and Him at the end. Hate to lose him, he PAID on time every time with no complaints. Can't help him with the Daughter snafu though. She's really a piece of work. Not sorry she's leaving as we have had 2 major arguments in that time. I listened, she yelled, and then apologized for being so upset over nothing. Water under the bridge I told her. I can take it. Taught high school for 33 years, mostly special programs, involving difficult students who had tons of life problems. I'm used to it. It's just the UNKNOWN of getting someone new here again. Anyone making such blanket statements without knowledge of the circumstances of the other person is a fool.

If the water is put in my tenant's name, and he does not pay the bill, well, my water company does not turn off his water. The water company just lets the water bill accumulate (and it becomes a lien against my property). The water company does not tell me about the situation -- that would violate the tenant's privacy rights! When the tenant moves and the next tenant tries to put the water bill in his name, the water company refuses to turn on the water and to transfer the water account until the prior tenant's bill is paid in full. So I am stuck with the water bill; or I cannot provide water to the new tenant.

Instead, I keep the water in my own name and every month, I add the water bill to the rent. This is a pain in the backside, but if the Tenant does not reimburse me for the water bill, I can evict (after the moratorium is over). And I don't get slapped with an unexpected $600 water bill! This has nothing to do with the virus and the eviction moratorium; it is simply how my water company and Public Utilities Commission operate.

So, WL, you want to call me a fool? You already did.

Good points Mike45. I had forgotten about the cCity and its habit of charging the 'landowner' for various things. I had tenants paying their own trash bills UNTIL I got a notice of LIEN on my property for non-payment. It kicks back to mandatory payment from the landowner no matter if it was in a tenant's name. Barely avoided that one as I stomped down, got the gal out of bed, told her I wanted the 6 months past due trash money and paid it that day. Since I didn't get those bills, I had no idea what was happening. Now I do as you do and calculate what the trash bill and water bill will be and include that in the monthly rent (again NOT telling them how it works). Gas and Electric thank goodness, only charges the name on the billing and doesn't hold anyone hostage for new service if the old tenant doesn't pay. They also leave the gas and electric service ON for about a week after the tenant gives notice so I get some free electric for a bit. Then it suddenly goes off. Oh well. Nobody is charged for the lag time. Life in general is difficult some times. --72.199.xx.xxx

You are right, this tenant much better than the last nutcase (who actually had the nerve to email me and ask if her 'Stimulus' check was delivered here by mistake)! Geez. Actually it wasn't by mistake, she never changed her address, so when it came, I returned it to the Main Post Office. Friends said I should have shredded it. I'm not into retaliation. Karma will get her someday and maybe in the next 9 years I will FIND her new address and be able to get some of the 7 months back rent from her. I must be dreaming. Ugh. $12k per meter is a good chuck of change. And, I would wonder if they would even do meters right now? Dunno.

Retirees and tech fields sound pretty good right about now, if you have decent internet service for the techies. My husband’s boss just announced they are not likely to open his office at all this year, working from home has worked out so well.

Ooh, rats. Wish had told you what I did when an old tenant’s taxes arrived. I picked the envelope up at the rental from current tenant, met the former tenant at her bank where I stood by as she cashed check and handed some ( $100 , or 200, don’t recall, was about half of the final water bill, which could be argued was due to faulty toilet flapper....) over to me. Karma had already been getting her, I wasn’t going to bother asking for more at the time, especially because toilet flapper was stuck when I got house back. Didn’t know how much the tax refund check was. Those envelopes are very hard to read through!

I have a huge 4 BR SF that is now vacant. I could pull in about $25,000.00 in a year from it, or I could spend thousands o. An eviction ( a year from now) . It’s beautiful right now. LordZen, when were were coming out of the housing meltdown, I thought those big four square duplexes that are abundant in my city would make terrific single family homes, especially the ones that are on a street with mostly single family homes. My brother has a four-square farmhouse way out in the country, they added a beautiful long front porch and new door , with sidelights, on it. Now it is gorgeous!

With the ‘new economy amid this pandemic’ having a nice home office will add so much value to you, if you are working from home. My husband’s boss just let him know he can expect to continue to work from home for the rest of this year for sure; it has gone much better than the company expected.

If it were me ( and it’s not,) I’d make the upper unit’s kitchen into the home office, that way no toddler’s running overhead when you are in a conference call.

And, speaking only for me, ya can still hang out here, even if your only tenant pays rent in hugs and kisses. (from the baby, for those that might misconstrue....) though we’ll probably encourage you to go get another duplex/ rental as well..... I will.... --70.92.xxx.xxx

Well, I evicted 2 deadbeat tenants last year and I noticed they were getting dunning letters from Helix Water District and SDG&E after they left. One evictee had been running an extension cord to my laundry room to get electricity to run her 3 Xboxes after SDG&E disconnected the Apt.

Another batch of evictees in the San Diego City Water district were evicted a few years ago and I paid none of their water bills. Think I have lost unpaid rent, but at least I wasn't having to pay over money every month for utility service for deadbeats during long evictions . . . The deadbeats usually jack into some other tenant's power and water - even gas line for one evicted deadbeat . . . --174.65.xx.xxx
