Couple with 2 teen kids on Section 8 said that they wanted one of our vacant rentals. We signed a lease yesterday, but have not done the Housing paperwork . She calls me a few minutes ago and asks about another vacant house (that is now rented) which tells me that she is not sold on the other property and is still looking. She said that the house that they signed the lease on yesterday has a moldy smell. Neither my husband nor I have smelled anything moldy. She says that she has allergies and cannot live in a moldy smelling house. Former tenant of 5 years never complained. Told her that I would put the house on the market if she did not want it. She said that if that is what she can get, she will take it. I am NOT comfortable with this and think that we should say good bye to her now. I do not want issues in a month or so. oh! mold the magic lease killer. Hate to tell you but you have a contract and unless it was contingent on Sec 8 approval you have a new tenant. You need in writing that she's still looking.

Didn't she walk thru the house with you? You need to let her know you have taken a new tenant for the MOLD house since she didn't want it but your in for a fight-- this is SEC 8 and that means they want what they don't want or can't have and you will pay for it.

Please, please, please....PLEASE tell me she doesn't have a copy. And WHY oh WHY in the name of all that is good and rent-worthy would anyone ever sign a legal document without having ALL the paperwork taken care of? *sigh I hope this isn't an expensive lesson.

Figure out how to get her gone. Everytime she does not want to pay she will say the place smells moldy. Every time she doesn't feel well she will say it is moldy. Contact Section 8 right away unless you can just tear up the paperwork. --173.61.xxx.xx

I almost never will do a lease signing until:

a) Got a completed application with state picture id and pay stubs.

b) Ran the complete back ground check, credit check, most wanted, criminal, social security check and checked references.

c) If it is a Section 8 person, I want to see their voucher and paperwork. If they have no voucher or don't have all of the paper work (with a case working on speed dial) -- I pass on them and try to find better applicants.

If you were going to get some government agency to pay most of your personal mortgage payments, wouldn't you have everything ready? If a section 8 applicant is lazy, I will not stand for this kind of laps personality of entitlement. --47.156.xx.xx

It sounds like the tenant is backing out by themselves, so the question is, do you refund the holding fee? Or what form of a contract did you sign part of and not understand the whole picture? I suggest you take a few months of housing provider classes for your local area before you open for business with only a partial understanding of what tenants will be professionals while you are beginning to be a novice. Sec8 is not the place to learn about landlording, hopefully your area has some HUD places they can go and you won't have high blood pressure 4-6 weeks from now. --76.188.xxx.xx

Did you give her the keys (Oh I hope not!)

Has Sec8 inspected and approved the home?

"Mary, we want you to be happy. Obviously you are not happy here. I will refund all your deposit if you remove your items in the next 24 hours."

DOCUMENT her communication about not being happy with the house. You might need it to defend your actions in court.

If this was just talk, send her a text about the conversation and get her to reply.

Why would you sign a lease without having all of the HUD paperwork(your guaranteed rent) filled out. Here were I am at I think the lease gets signed in the HUD office after the HUD personal has reviewed the lease and the observes you explaining it to the tenant. You also have to have your home inspected and approved.

I agree with others in that this family is a problem and you need to get rid of them now. Problem is that you have signed a lease with them and given them the keys. You need to get in writing or at least in text from them that they want to void the lease and you need to get the keys back. If they move in you will never get rent and always have problems. They may have lied about section 8 and not even have a voucher. Do they have one? I hope you find a way out of this.

Until recently we always signed lease paperwork before housing. That was standard. But until the inspector came from housing it wasn't going to be an actual lease as their paperwork had to happen. I would not worry about that. The house will not pass any inspection if there is this issue. My guess is this tenant doesn't have the negotiating skills to tell the truth that they dont want to live there for whatever reason. Its typical that someone from this income status would cry "mold" or sonething wrong with house when actually the issue is something else. Right now that's not your business. But if they move into your house it will certainly become your business. A year ago i had almost the exact experience. Just got the house back. It all worked out ok for me. But with section 8 you make money when they stay many years ... make no money if they move after one year. And they will only start ibe year to complete their obligations if you let them in and they are stating this already. There is nothing wrong with your house dont get stuck there defending your house. Think bigger and just let them go. You'll house will thank you later, check book too, when you find an applicant who WANTS to live there and will love it. --99.203.xx.xxx

If she gave them keys and they moved in, Then respond to every request quickly and professionally. The deal with Section 8 is that their paperwork has to be fully completed before you them keys. My office has even strongly and sternly voice that to me. Before our local office switched over to the current process, i would sign my lease with new resident and fill out their Section 8 packet. Then turn all that in at the local section 8 office. But i would not give them keys. House has not been inspected. Occupancy permit must have their names on it and myself and section8 must have agreed on the monthly rent. Its a process. --99.203.xx.xxx
