We are showing the house to a woman with two teenagers today. She recently split with her boyfriend of many years and has to find her own place.

What if a new boyfriend enters the picture and he moves in? She may sneak him in hoping we wont find out. I would like a sentence in the lease that addresses this issue.

The boyfriend may not pass our criteria for approval (f.ex. if he smokes). The lease would already list the people who are allowed as residents. However, this lady most likely would break the lease if we don't approve a fourth person, which again, makes her a less desirable tenant. . someone moving in can happen all the time ... adult child ... parent ... sibling yadda yadda. file for eviction due to unauthorized occupant.

Our lease states the number of approved occupants, and the tenant signs agreeing to this. We have a clause also that allows "visitors" only a certain number of nights per year, even if non-contiguous nights.

Yes it may be difficult to prove, but a few dated photographs of his car in the driveway early morning may be enough in court.

Also, we go into our houses every 6-8 weeks, so there would likely be other signs.

Another lease clause that may help is to state that any new occupants must be screened and approved by the landlord and must pay a screening fee of $xx

Add a policy where, if management suspects another person is living there, the tenant must show you proof that that person resides elsewhere. Within a couple days. This would be a CURRENT utility bill or other mail sent to them at another address, in their name. Or a current lease, accompanied by the landlord's contact information - you would have to verify with landlord they are still there.

Trust your gut. Probably a lot worse than smoking. They don't want you to do a background check on him. I've had people use this line on me, too --68.10.xxx.x

What David said... this is a common, everyday occurrence in the life of land lording.

To make it easier for myself, my lease specifies that if I have "reason to believe" an occupant has overstayed the Guest period, the TENANT agrees to provide me with documentation of the Guest's separate, legal address. Acceptable items of proof include a lease with land lord's contact info so I can verify it, a bank statement or utility bill from the current month showing Guest's name, etc. Putting the burden on the TENANT rather than ME to stake out the property 24/7.

That said, they still do whatever they want, whenever they want. I recommend inspecting the property 1-2 weeks after move in. Think of a reason: change the furnace filter, take pictures of insurance, need to check the water heater, etc. GET INSIDE. You'll find out pretty quickly when someone moves in. If no damaged and rent is being paid on time, I offer to add the person to the lease, no questions asked about when they moved in. If they balk...that's when the eviction comes. --107.216.xxx.xxx

Exclusive use lease by occupants listed at the beginning, with anyone extra who stays more than 14 days in any 100 (our court calls this grandmas summer vacation) then the rent goes up 50bux a month for each extra resident, OH is a 30 day state so you will know this gets added to the next rent cycle, balking is the beginning of the end, inspect for damages and add that to next rent cycle also. --76.188.xxx.xx

Here is what can happen the tenant moves out then the boyfriend stays then falls into arrears where you end up evicting with arrears along with completely trashed out rental unit. Make sure no cash is accepted for rent as not to start a tenancy. Often people try to get around the screening process where this is common. If the boyfriend wants to move in then the boyfriend must return a completely filled rental application with at least three pieces of identity and social insurance number. Often they add or remove one letter in the surname where the credit report comes back no identity. It maybe better to cut losses right away where if he refuses a thorough credit, background check then it is better she moves out. --147.194.xxx.xx

We have the "guest" rule in our lease, No subletting, and require a full screening if they want to add anyone to the lease. I let them know that if the "future boyfriend" does not pass screening he cannot exceed the guest rule or eviction will follow.

Full screening includes, credit, employment,income, criminal history and rental history.

Looking them in the eye and saying "my lawyer can have an unauthorized guest eviction done in less than 30 days" tends to get their attention.

The old bait and switch is getting pretty common. One person with acceptable credentials gets the property, a bunch of flunkies move in, good person moves out leaving you with the loosers. --137.119.xxx.xx

As others have said, I have a clause in my lease that basically says no more than 15 overnight guests during the term of the lease or 7 consecutive days, no subletting. and anyone over 18 living there must be on the lease and pass my screening. --174.192.xx.xxx
