security dep never return (by Jennifer [WI]) Sep 1, 2019 11:00 PM
Message:

In 2017 I rented a 3 bedroom in our city. The landlords were cons and I reluctantly had to call building inspectors. I ultimately found new tenants myself so that I could leave. Tenancy ended smoothly. The landlords never returned my security deposit of $850 nor did they send me a letter explaining why they took money off of it or reason for not returning it. I video recorded the entire house when I moved in and when I left to prove no damages.

I'm in Wisconsin and someone told me that they owe me twice the security deposit back if they never returned it. I moved out August 2017. I was the victim of a violent crime and did not have the state of mind to sue until now. --131.93.xxx.xx

Run your scenario by an attorney to have them lay out your options. You may be time barred from getting relief. --174.225.xxx.xxx

Instead of listening to "someone", read the law for yourself, and call an attorney to learn your options. There is a link to state laws in the upper left area of this page.

And brace yourself - you are on a landlord website, & I suspect a few choice words are coming your way.

Building inspectors - really?! --68.10.xxx.x

Jenny WI-- you do realize this is a LL'd site? As LL's one of our first lessons (LLing 101) don't ever believe tenants. See all we have is YOUR story and we all know there's the REAL STORY and we'll never get to hear that.

I didn't catch (there's always a reason) WHY you left until your last paragraph-- you were a victim!!!!!! You sure got the I can get 2X back part though???? --99.103.xxx.xxx

As Frank said, the statute of limitations may have run on your claim. Also, just because you never received it doesn’t mean the LL never sent it. The LL may have the unopened, returned accounting letter sitting in your file. Did the LL have a correct forwarding address? If not, did you have the post office forward your old mail? --50.107.xxx.xxx

If you found new tenants yourself so you could leave that may be considered sub leasing and then deposit stays with the unit. --24.61.xxx.xx

"reluctantly had to call building inspectors" - LOL!!! That's a good one. This right here tells me you are only sharing your side of the story. As DJ said, this is a Landlord site. You won't see much sympathy here. I'm actually surprised it's been as nice as it has so far. --68.102.xxx.xx

Well, you broke your lease.. How long were you out before you found the new tenants for them? Maybe you owe some rent for the time the place was empty. Sorry you were a crime victim. We all need to carry a small pistol and don't let anybody tell you different. Politicians are dumping illegals on us and want to take our protections away. I read a statistic yesterday. Illegals are 7 percent of the population and commit 64 percent of the crimes. --173.61.xxx.xx

Lets break this down a little.Reluctantly had to call building inspector means she knows this is a landlord site and is looking for sympathy, none given.I found new tenants myself means I had bigger deadbeats than myself living in the unit and I left them there when I moved out because they were the reason I was the victim of a violent crime. The landlord didn't return a security or send a security deposit accounting letter because you never told him you moved out so as far as he was concerned you were still there when he did a formal eviction against both you and your former boyfriend.Somewhere in WI there is a judgment filed against you for about $2555 for the 3 months of unpaid rent your landlord won at the hearing.By all means sue him so at the next hearing he can get your current address and place of employment so he can collect on the judgment that he has,and yes he can collect the whole thing from you not just half --72.231.xxx.xxx

I wanted to respect everyone's time. However, I am happy to explain why I had to call the building inspector. My family owns their own business and we owned rentals since I was 2 so I deeply understand the seriousness of making complaints and involving a crooked government.

These are the reasons I had to call:

•in our small community my landlords turned out to be known con men. The wife worked for a nationally known business and exploited her association to appear she rented units for them. The husbands family owned a business know for drug sales

•any time I had a valid concern about the unit (see below) the husband would come over and let himself in to confront and bully me.

•serious repairs were needed during my tenancy: the back door literally fell out of the frame into my kitchen, he didn't show up to repair it for 2 weeks leaving a safety issue in our downtown area. This was particularly scary because I was almost murdered a week before. The glass in the large window of my disabled (in a wheel chair) roommate was cracked in half and shattered into the room when she tried to open it. He never repaired it and left us to tape duct tape over it. The woman landlord lied to us before we moved in that we had control of our own heat, they went as far as installing a dummy gauge into our into to fool us into believing we had control. Ultimately the upstairs tenants had full control of the heat although I had to pay electric bill for both units. This often left our unit dropping into the 50''s during the winter due to poor distribution by old furnace. There were no smoke detectors installed and I wasn't given the lead awareness forms as required by state. They refused to give us a copy of the signed lease. They required we sign rent checks over to Shorewest reality although that was not associated with the unit. The supplied appliances with one working burner and refused to repair it when it broke. The front door lock had stripped screws and would easily slide apart, the drug dealing tenants upstairs knew this and "accidentally" popped it out while I was gone leaving us having to keep all valuables in our locked car. Said tenants also looked through our windows and twice saw me naked after a shower in my room. The front door storm door was original to the 120 year old home and flew off during a storm shattering all over the porch. They never came to fix it. The crime was committed to me by my tenant, police where involved and by law landlord was required to change the locks. Instead he threatened to evict me because she left the lease. The second step to the back porch rotted and broke leaving empty space, refused to fix. The husband came to fix the back door and attempted to deny that I paid the rent for that month so he could evict me, my mom showed up with the proof of the check cashed, he yelled at her and told her to get out of the house claiming he had the right to demand this because he owned the building. I was already illegally paying the upstairs gas bill, then discovered that they ran an extension cord down to the basement forcing me to pay electric use for their air conditioners. Landlords said it wasn't their problem. When I notified them that I had to leave state law requires that they show effort to rent out unit. After a month of them failing to do so I marketed and found a new tenant. They signed papers to close my lease and give them a new one. They told me they would be returning my security deposit by law. I gave them my new address in writing and it never came. They stopped reaponding to my texts.

Can someone please help me find the statute of limitations in Wisconsin for return of security deposit? These are the kind of landlords that give good ones like you all and my parents a bad name. --131.93.xxx.xx

Something is adding up here! Your wheelchair bound roommate assaulted you, your family owns rentals since you were 2 yet your asking strangers online for advise, the house you describe sounds made up, why would you stay there? How did you “ market it and find a new tenant” with broken steps, broken windows, broken locks, no working appliances etc etc? SORRY BUT I CALL BULL S**T. I don’t think your telling the WHOLE story, were you hooked on drugs at the time? Then it would make some sense, because I don’t believe for a minute you were a perfect, paying rent on time, hard working, law abiding tenant. --72.224.xxx.xxx

Wow, y'all are a harsh bunch!

Jennifer, never mind the rock-throwers. They're hardened through bad experiences, but they're a decent bunch for the most part. I'd suggest you talk to a lawyer that specializes in landlord-tenant law. I don't know where in Wisconsin you're located, but Tristan Pettit in Milwaukee does a lot of this work. Talk to him to see if you have a case. The law is often specific to the city you're in, so I can't answer your question with the information given. If your landlord really was as bad as you describe, I'm sorry--most of the people on this forum are ethical and conscientious, so have a hard time believing a story like yours. Good luck! --204.210.xxx.xxx

I am with JKJ Jennifer. If the place was so bad, why would you sublease (i.e. find another tenant)? That to me implies it was suitable living space. I think you should follow Robin's advisement for best results. Good luck. --173.69.xx.xxx

When you apply to rent a new place, be sure to tell the new landlord that the old landlords were cons and that you were willing to report them to stand up for your rights.
