The city will not remove a dangerous tree that is threatening my house. It is hollow at the base and leaning toward the house, and it is a big heavy tree that would do a lot of damage. The home is vacant and needs to be renovated before occupied (also not currently insured).

Note: the tree is the city's responsibility since it is in their section between the sidewalk and the street. I got them to remove another tree last year under similar circumstances, but they won't remove this one because they say it's not dangerous. This may just be a matter of not getting a hold of the right person.

At any rate, does anyone have any suggestions on how to make the city liable if it falls? I have reported it twice with case numbers, but that may not be enough. I'd really like to send some kind of certified mail informing them they will be responsible for damages, but not sure what procedure to follow (maybe get an arborist to certify it is dangerous, or ?)

1. Send a letter detailing the situation soon with 2 or 3 pics. No threats, histrionics. The facts ma'am just the facts. Send the letter to the mayor, Boro atty. or whoever you think is in charge.

Be sure to send via certified mail and also regular mail.

Include a deadline for a reply. This way if there is an 'event's you have definitive proof the town was notified of the danger.

Line up an arborist for when and if they make you prove it.

Any electric or phone wires involved? Our electric company will remove a tree or branches for free if it can take down wires. I didn't know and called somebody to cut branches. He was a con artist who knew the electric company would do it for free. As required by law, once you put your City on Notice of this dangerous situation, if the tree falls on your house after 30 days, then the City could be held liable.

Of course you have to send letter, certified with a return request receipt. I would send out many copies of the letter to various department heads and hand deliver one copy to your loack representative.

As others have said, send certified letters to dept. heads, selectmen, mayor, what have you, stating the tree is a dead/damaged and will damage your property when it falls. In MA the property owner that the tree is on, (in your case the city) is not responsible for trees that fall by an act of god. Get the arborist to certify the tree as dangerous, send it to all the relevant city/county officials, then after a few months of inaction, before you fix up the house and rent it, either pay someone to remove it, or pay someone to remove all branches on your side so it falls the other way or pay someone to shorten it so it will not cause much damage.

Before I fixed the house and especially before I placed a tenant in there, knowing it's a dangerous tree, I'd remove it. If it hurts your tenant, you'll be liable since you know it's dangerous and there will be plenty of letters in city hall proving you knew it was dangerous. --108.69.xxx.xxx

Be able to prove you notified them. I’d send it to the city atty too.

As I understand, the space between street and sidewalk (called the tree lawn) is MY responsibility to maintain. The city does not OWN it, they have an EASEMENT to use it.

And RIGHT NOW get it insured. If it does fall you’re sunk. Don’t ever believe the city would ever pay for damage, esp when YOU know it presents a danger.

Apparently I would have to get a "Flora permit" in order to take the tree down, at my expense. I don't know how much the permit costs. At any rate, to me that shows that it's their tree, so it's their responsibility. They did take the other one down that was dangerous (same neighborhood, different house). --99.0.xx.xxx
