I received a call from an apartment manager asking for information on my current tenant. I had no idea that my tenant was looking for another place.

I provided a satisfactory reference to this manager even though the tenant has been always paid the rent 4-5 days late and has had 2 noise complaints filed against him

I called the tenant the next day to ask if he was planning to move and if so how soon was he planning to do this .

The tenant said that his live-in girlfriend is pregnant & that they need a bigger place to live than the 2-bdrm. 2-bath townhouse he rents from me. His rent is scheduled to increase (by $50/mo) on Sept 1. I told him that if he stayed I'd reduce the increase to $25/mo.

He says he'll let me know on the 2nd of September

MY question is can I start advertising the vacancy in the meanwhile. Actually , this would be a notice saying that I'm acquiring a list of names of potential tenants for my property which may be available Oct 2 or Nov 1.

Is this something I can do. Thank you.

Why even confuse people and say all that.

Just run a normal ad. Then if you need to just tell the truth. The currents tenants had planned to move but have now decided to stay. Simple and no problems.

Even when a good tenant gives me a 30 day written notice they will be out by the 1st of the next month, things can still happen, and they do. For example. the place they plan to move into may not be ready. Therefore I would never jump the gun and start advertising a vacancy that is in the making and not complete. If rent control kicks in then there is little opportunity to increase rent. Once they start the rent registry then you are locked in forever. Generally in rent controlled jurisdictions rents are higher and vacancy rates are at zero or near one percent so the rules of supply and demand becomes reality. As vacancy are zero or near one percent then tenants have to take or leave it as when one refuses others are lined up to take a rental unit that meets all the building and fire codes where it is below a market rental unit. So the government thinks tenants are fools as tenants always worse off in rent controlled jurisdiction as Air BNB becomes more common therefore decreasing the amount of vacant rental units. --147.194.xxx.xx

Well, you already told him you would reduce the increase which was a mistake. He's not a good tenant, so you should have let him go.

You can legally take a waiting list but in Oregon, you can't charge an application fee unless you actually have a vacancy, which you don't have at this point. If it is a waiting list, your ad must state that.

You can't give him notice or you will have to pay him relocation money.

Oregon proposed to bring in state rent control so conditions changed if passed. Rent control causes the rental supply to diminish quickly as first many of single family houses are sold then some rentals are converted to commercial. I am with Oregon Woodsmoke and myob. It doesn't sound like you have a good tenant. Why would you reduce the rent increase on a tenant that always pays late and is not giving you notice? You need to let this tenant go. He is saying they need a bigger place then a 2br/2ba and it is just him and his pregnant girlfriend. Is she having quadruplets? Are you sure they haven't moved others in? You may want to go inspect your house. --73.120.xx.xxx
