Had a person who's messaged me on FB a few times in the past.

Back in March, it came up--

Her: ...have a service animal that 1/2 pit 1/2 English bulldigand has the temperment of the English

But, alas, neither she nor her fiance had employment, so I suggested they get some income and solid employment history established, and feel free to reapply later.

(BTW, I saw a photo of the dog... if it's "half English bulldog", you couldn't tell by looking at it...)

Fast-forward to this evening, and she was reaching out again, seeing what vacancies I had.

Me: It depends. What kind of animals do you have to take into account?

Her: I dont have any pets

Me: (re-reading the archive more clearly) Ah, that's right. Just the service animal, right?

Her: I currently do not have my service animal she is staying with my ex husband

!!!!!

A real service animal just doesn't get left with some random person. A real service animal is as much a critical part of your well-being as your oxygen tank or a wheelchair. Which is why they are treated as "necessary medical equipment" instead of as "an animal."

Anyhow, they still didn't have good enough income to qualify... but it was a nice data point to file away in the back of my head for the future...

Anyhow, random anecdote for the evening.

In other news, I'm looking at some people who are totally, for sure planning to leave their dogs with her father so to avoid paying the pet fees and pet rent... -_- --96.46.xxx.xx

Funny. They leave their girlfriends, boy friends, leave husbands and some leave wifes. But leave your service animal! Comfort wife? Comfort Boy Friend. How random for sure. Suddenly i dont need by service animal cause ive been "trained" that the dog is the reason i can't get a place. So my work around is not to have the dog in sight. Rent a place ( not having a job shouldn't be a reason, right?) One i get a place i will suddenly need a comfort animal to cope cause of the stress of the next rent due date. This is a new approach. Notice the "currently" with ex. To me, this reads "as soon as you rent to me, I will bring my pit on site. Since it's a 'service animal', you can't do anything about it."

It also proves to me how much they NEED that animal. As you said, this is SUPPOSED to be treated the same as medical equipment. You wouldn't leave your O2 with your ex, why does your "service animal" get left with your ex?

Since someone mentioned pit bulls, I will throw this in here. On one of the beaches last week, I think Wildwood, someone had a dog on the beach. It was a pitbull. A young boy approached the dog and it's owner and asked if he could pet it and the owner said yes. When the boy bent over and reached out to the dog IT BIT OFF HIS NOSE! Yes it took off his nose. The owner and dog ran away but were found by police. The boy was shown in the hospital with bandages over his face. They said it will take years of surgeries to rebuild his face. I got a letter from my apartment insurance agent that if I accept any known dangerous breads of dogs to live in the building, my insurance will be cancelled.

And the letter further goes on to say that any dog poses a liability issue and they wanted me to confirm the dog is licensed and the tenant carries current renters insurance covering their dog -- pet, service and comfort. Since dogs bit all the same.

I even have a cancellation notice from a prior tenant back in 2014 for having a pit bull dog that was so unpredictable, the tenant kept it chained up in the yard all the time. It never stayed in the apartment. Not socialized. --47.156.xx.xx

Good job Deanna. It didn't take her long to, supposedly, ditch the service animal. Robert J brought up a good point. I need to ask the judge, the next time I sit in on court, how someone is supposed to satisfy the law and insurance at the same time. --73.120.xx.xxx

6X6, my understanding is if your insurance will cancel your policy due to a SA/ESA being a certain breed, it would fall under undue hardship. BUT, be careful, you would need to produce proof that you notified the Insurance Company its a legal SA/ESA, in addition to a letter from the Ins. Company stating they will cancel your policy because of that specific animal. My understanding also is you will most likely never get that from a insurance company because then they can be sued and HUD will go after them for violating the law. --72.93.xxx.xx

I wouldn’t count on insurance cancelling you. I called my insurance company a few years ago about my student who brought her “American Staffordshire Terrier” back after summer break and they said they could not cancel me because the tenant had gotten an ESA letter from a counselor in her home state of Virginia. --71.168.xx.xx

Exactly! Great to see an example of what I've been saying here for months now. Thank you, Nellie, for sharing that.

And, like JKJ said, you cannot deny an ESA based on "hardship" simply because it is on a "restricted breed" list from your insurance company. It must be a statement from your insurance company that they will cancel if you take THAT PARTICULAR ANIMAL that you have notified them is a documented ESA. And, again, as far as I've ever heard, no insurance company has been willing to do that because they know it is a can of worms.
