I want to add a paragraph about open windows in winter or rain. Please tell what do think about this one. We are paying for heat, but tenant has his own thermostat. Please tell if I need to change grammar too :)

HEATING SEASON: Heating pipes can freeze and crack in cold weather if windows are left open. If windows are open due to negligence and pipes burst, residents are 100% responsible for the cost of repairs. During heating season all apartment windows must be kept closed with the sashes properly locked to prevent heat from escaping. Resident will be fined $50 per occurrence.

Normal temperature of your apartment should range between 65-72 degrees Fahrenheit from 6am to 10pm and 60-68 Fahrenheit from 10pm to 6am. Adjust your thermostat accordingly.

Keep furniture and bedding away from the radiation units. You will get the most heat from a free-flowing radiator.

I do not understand why some tenants have window open during cold. My contractor keep telling me they have window open because they use drug and feel hot. I do not know it is true or not, but I do suspect their adults children use drugs and I found one on public record. Then my contractor told me they thermostate is bad and they did not bother to tell me. We do not pay utility bill, but I made the two families moved out they because also have visitors and parking problems too. --97.91.xxx.xxx

Resident is responsible for closing all windows, door and vents in their residence during inclement weather. That weather includes. but is not limited to, rain, snow, gusting winds or other weather related items that may damage the home and or HVAC (heating) system. resident is specifically reminded that all windows must remain closed and secured when temperatures are below 62 degrees.

Should resident be found in violation the lease shall be terminated and resident will be required to surrender and vacate. Frozen or broken plumbing is never acceptable and all Residents are expected to maintain their property accordingly. Resident acknowledges that they will be responsible for damages caused by their negligence.

Did you ask why they had the window open? Don’t assume it’s drugs. Humidity in my house in the winter is about 5%. The only way to get the air comfortable is to run a whole house humidifier on each floor or to keep a window opened slightly ( especially effective on rainy days). Running a large humidifier on each floor is tough on the electric bill. No way mold could grow here though. --71.10.xxx.xxx

I think telling residents what temperatures they must keep their house at is a bit over the top. Pipes will not freeze at lower temps than you provide unless they are on an exterior wall and it gets VERY cold outside.

I am ok with some of your wording but I'd get some of that detail out of it. And in court, what will be defined as "heating season"? I'd say something like "when outside temperatures are below xx degrees F". That way you have historic weather data to take to court.

Some people keep windows open because one family member likes it warm while others like it cold...so they heat up house for those who like it warm then the person who likes it cold opens the window.

I don't know if this is possible since I don't own a property where I pay utilities, but.....

Could you state a maximum heat bill per month that you would pay? In other words, if the heat bill is $125 you pay $100 and the tenant pays the remaining $25? May not be possible if this is a multi unit...but just an idea. --99.92.xxx.xxx

Yeah .... this is stupid tenant logic when they don't have to pay the heating bills. You keep the tstat at the lowest comfortable temperature, and those that like it warm use a space heater. This works even when the window is not accessible. --144.250.xx.xx

Last winter tenants from the other building was complaining about cold in their apartment (we don't have SFH). We asked which room is colder and discovered crack open window! (You know, for the fresh air...) Outside was ONE degree Fahrenheit (-17 Celsius). We advise everyone to take out A/C and close all windows before this visit, but they didn't bother and was complaining instead. --161.69.xxx.xx

I would take out the fine. your clogging the clause with meaningless stuff. Judge would say-- fine for what? what damage? Did you pay 50.00 in more gas usage? Is that 50.00 per window per day-- it's just static and when thinking about a tenant-- there now laughing at you for the 50.00 FINE. -- and the temp range.

"Normal" to you and me-- well if someone else is paying for heat for me is a different Normal. Setting the thermostat to a minimum of 60 is good but mentioning the max-- well they won't care. --99.103.xxx.xxx

Consider installing a electronic boiler control system like a Tekmar which has a warm weather shut down feature where the heat will turn off on warmer days and nights. Also installing locking non electric thermostats on radiator loop where the heat will limited. Check some videos on You Tube. Most bi metal indoor outdoor thermostats turn up heat when windows are open which encourages more windows to be opened unlike a electronic boiler control system. Insulating all the heating hot water pipes in the boiler area will not cost much but will save energy. Remember one time a tenant complained about heat where went into with a thermal camera then showed the radiator was working then showed the problem was a open window. Close the window then the heat will stay inside. Another expensive option is to install high efficiency wall mounted gas boilers in each rental unit then separate out heat where the tenant controls and pays for heat. Tenants in my mastered metered apartment house were leaving their windows open and cranking up the heat to maintain their comfort level -- at my expense.

My city doesn't allow me to install separate meters and charge tenants for their use--changing the terms of the rental use. I still went ahead and put all of my tenants on separate meters for their Gas, Power and Water.

It was no surprise that after a few tenants moved out and I was able to then require new tenants to pay for their own utility use, newer tenants were consuming around $18 to $35 a month for natural gas while tenants on my dime were exceeding $100 a month... --47.156.xx.xx

When I had the fourplexes, an open window was a sign of someone smoking something they didn't want others to smell. Sometimes in multi's there will be a cold unit and the person with the thermostat will be asked to raise the heat. Then everyone else is too hot because the problem is in the radiator in the cold apartment either blocked by air, rust or mineral deposits. So you may want to check for problems in other units when you see a window open. --173.61.xxx.xx

About the windows... Well, tenants was complaining about cold, but keep the windows open!

Like open a kitchen window, but telling that it is cold in a bedroom. Or have about an inch gap in a bedroom “for the fresh air” in a middle of the winter and complaining that the kids are cold, while the kids are running in a t-shirts and barefoot.

Just lookup magnetic door switches for a security system and put on all the windows, when one is opened you wire it to turn off the heat, motels been doing this since who knows when, only takes an afternoon to wire up a place. --76.188.xxx.xx
