It depends. Are you retaliating?

If you're terminating their lease solely because they called inspectors for a legitimate issue with your property, then yes that's illegal and not only that, it's immoral. If your property was substandard and they called due to lack of timely and proper maintenance, that's their right to report it and have it fixed.

On the other hand, if they've been violating the lease this whole time and this is just the latest attempt to annoy you....then NO, it's not retaliation, but a judge may still view it as such. Have they got a history of not paying rent on time? Moving in unapproved residents / pets? Damages to the unit? Other lease violations? If you have done your due diligence and been documenting evidence of their lease violations, then you should be on solid ground and can end the lease.

Bottom line: if you get called in front of a judge, what EVIDENCE will you show to prove your case? --173.20.xxx.xxx
