If the vacancy rate is low then it is easy to fill with a better applicant. Usually after a credit check is done on all adult applicants then there is more information available. Often the rental applications are incomplete which means they are hiding something. Unpaid utilities, unpaid bills, collections and judgements are all a non starter. It is a lot more difficult if the rental unit is vacant. Consider joining a landlords association where can get more specific advise. As a result of the rigid rent control system in the province of Ontario the majority of rental housing providers do not even go near anyone with a credit score below 700 or unstable rental history. Most major towns and cities the vacancy rate is zero or one per cent where more expensive rental units are available in Condos. Google to find landlords associations. --147.194.xxx.xx

First a person has to qualify on the non-personal issues: income, background, etc. THEN Jeffrey teaches that the #1 qualification is cooperation: with me, with the process, with the lease. Trust your instincts and refine your judgment. Then get better at trusting your instincts and better at refining your judgment. I have some folks who show up and I could instantly tell that I will not let them live in my units. And then I have other folks show up and I want to do what I can to get them to move into my units. That's just how it goes.

Yes you can reject for that....but generally it's not a good idea.

Why not?

Because if this person is any one of the dozens of "protected" classes and decides to sue you for illegal discrimination, you will be asked to provide the reasoning for why you rejected their app. "I just got a bad feeling about them, Your Honor" will not impress the judge and likely you'll be found guilty of illegal discrimination.

So your job now is to think over carefully what it is that make your gut-feeling alarm go off. Are they dirty? Late? Loud? Boorish? Demanding? Lazy? Moving around from place to place and/or job to job?

There is a reason: you just haven't found it yet. Find it and deny based on that reason. --173.20.xxx.xxx

And once you find that reason as Sid described, write it down - add it to your written criteria.

Bottom line, though - trust your gut, to keep you safe above all else. If a situation or person gives you the willies - leave.

If you are meeting a prospect in person, take steps for your own safety - another person with you; arm yourself; have your cell phone on you; someone here recently said they wear a body camera; at LEAST tell someone where you are going, who you are meeting, and when you expect to be done - maybe say "call me in 15 minutes". --68.10.xxx.x

However, as S I D points out, you must find an objective reason of why they are not cooperative and make sure that objective reason is part of your written criteria or screening scoring system:

3 quick examples could include:

Late for showing appointment

Not completely filling out rental application

Not bringing everything requested to the appointment (i.e, pay stubs, current utility bill, etc.)

Using offensive language

We have a prospect come to our showtime yesterday. She drive a van (?10 people van), not mini van. Very hard for her to come down and walk into the house because of very heavy (500lb?). She did not talk to me at all, and went to her van. then Keep sending her 15 year old daughter to ask me question. and the daughter has to back to her mom for answer to my question. I was told her job is care taker for her other child in the van. They said they already applied (but we did not receive application, nor application fee). I do not know how we communiate if they move in. I am worried what to say if they really apply. --97.91.xxx.xxx

“Everyone is welcome to apply” and make applications easily available keeps the LL good with Fair Housing law. A LL cannot refuse to give someone an app.

You asked about accepting the APPLICATION. Yes you must RECEIVE the written, signed application. You cannot refuse to receive an app.

You can deny the PERSON based on the info provided on the application compared to your written criteria which should include Jeffrey’s cooperation score.

Gut. Only believe your gut when it is warning you, NOT when you have “a good feeling” and want to “take a chance” on someone. Chocolate gives me a “good feeling”.

You can do a search on "Declined applicants" in 2019 to see a post about rudeness. You could also do a search on "reject" in the subject box and choose all years for other examples. I have been in your shoes and am following this post.

CJ, in-person communication and cooperation seems to be a problem with that woman who wouldn't talk to you at all. Using Jeffrey's list, you could include in your criteria something like, "Must be able to communicate in-person."

YES. But remember that,just like anything you do as a landlord, you may have to defend in court.

CA courts will accept a reason like applicants apparent inability to get along with landlord. But other posters are correct to point out that your reason may be confounded with discrimination against a member of a protected class.

Moshe, thank you very much for your post. I was reading your other one under the thread, "NY Landlords," regarding the character of the applicant. When you have a moment, would you please note how you would reject a qualified applicant whose character was not suitable, according to your opinion? I would love to know the wording as a example that would stand up in court. It's a 'gut feel' - Dirty car, Smart-A$$ attitude. It's a 4 br 3 ba home in Laguna Beach, which is very close to a fine School District. I usually have them for a few years, and when I get someone who starts with - How much better can you do on rent: How about if we don't have a gardener?

Laguna Beach? Wow, thanks for the information about the prospective tenants, and it's no wonder that you're wary about them.

I liked the post entitled, "Best Canned Responses", from 2018 and kept it and the responses in my records. Here's one from RathdrumGal:

WMH , I know what your saying about CJ and the fat people. But I tell you what. I have had 2 different tenants that weighed 400lbs or more.... one was a married couple the man probably 500 plus the wife 300 and the other couple was at least 450lbs each and NEVER AGAIN for me.

All of them are the rudest, laziest, most disrespectful, self centered , filthy dirty, ignorant, arrogant people in the world who will not follow your rules and will tear your property up while continually griping that your not doing enough for them. I totally see the red flags waving. I had a tenant with an attitude that wanted to know if he could paint or he could pay for painting the home that had just been painted. He wanted to take care of cutting the grass. I don’t know if I could do what I did but I told him you need a home where the landlord will let you paint and allow you to cut the grass. I said you will be unhappy every minute you live here and he excepted my remarks and went on his way. --99.23.xxx.x
