We rented a nice 2BR to a couple of young girls. One had poor credit so we insisted on a double deposit, $300 of which is still owed. Now there is discontent in their partnership. One, (who I am told hasn't paid her portion of the security deposit, "not my concern whose money, just pay me"), got a new puppy which is not allowed under the lease. She is claiming it is helping with her anxiety and depression but it is not certified, yet, as a therapy dog. The other room-mate wants her to leave with the dog. She sent a laundry list of complaints about her roomie to me. I told her that I cannot and won't try to sort out their interpersonal problems. The lease is in violation, and I want my money and the puppy has to go. I told the girl with the puppy the same thing. She tearfully said she understood and would return the dog. Now she is playing the Therapy dog card. The money is still on table. Now what?

Did she use the term "Therapy Dog?" Not covered by ADA OR Fair Housing...she doesn't know what she is talking about.

No WMH, she did not say "Therapy Dog" she only has said that the dog is to help with her anxiety and depression and is scheduled to go to a six week training class for something, (basic dog obedience?). --76.189.xxx.xxx

Let her run on about the therapy dog, it is and always be a pet which apparently breaks the lease, OH 5321 gives 30 days but you must give written notice to cure. I get lots of requests for new pets, need photo vet to records proving distemper and fixed, pet registration fee or simply return to where they came. This happens with subsidy tenants also, legal aid threatens but we must follow the law and the lease.

I was typing when you posted but photo vet records showing distemper legal on every walking animal, if the in state doctor letter is absent then fictitious but it sounds like the up 2date roommate is objecting also.

I find that not turning over the keys until all monies have been paid in full & utilities properly transferred helps avoid some of these problems. Time to issue a notice to cure of any lease violations. Depending upon what your rental agreement says about how monies received are applied you might also proceed with a non payment eviction. --96.237.xx.xx

I don't understand how they were able to move in without paying all of the deposit. Do they otherwise pay there rent? How long have they been there? You should be able to evict(after notice)for failure to pay and other lease violations. --73.120.xx.xxx

I have not had roommates in a while, but do have a general roommate agreement that I make sure they use as a guideline to draft up a document for their use. This helps clear up any misconceptions before they move in. --24.194.xx.xx

6x and others, if you write up an agreement just apply monies to the deposit, fill in the shortage in the rent column, then your local/state tenant rules covering rent shortage with no dispute in court. OH5321 explains a little of this but local rules indicate the court timing and process with partial rent payments.

ugh!!

I am dealing with a roommate h*ll situation too. We rent mtm.

2 girls move in 1/18/19

Girl A calls me and asks how she can get her roommate out and she hasn't paid her share of deposit. I tell her I will release Girl B from the lease if she sends me a written notice. Girl A qualified on her own. Girl B does not qualify by her self.

Few days later 2/25/19 Girl A call about giving her move out notice. I said fine get it to me before 3/1/19 to be out by 3/31/19. She sends me a written notice.

We then post move out notice to all living in the house to be out 3/31/19 because I didn't want to be left with Girl B

So now everybody will be out of the house and we will start over. Even though this is a pain I think we will be better off in the long run because Girl B would not qualify. --165.201.xxx.xxx

kkezir, that is pretty much the same here. One with dog has agreed to leave and she is the one that does not hold up her end on payments per the other. I think we will end up at square one, but hoping for the best and giving them a 30 day to cure. Vee and AllyM, I reminded them that per our lease all money goes first to oldest due date so the rent is behind and she said she will pay up. Meanwhile I am going to 3 day as well as I believe that is what will be the way to go in the end. --76.189.xxx.xxx
