This is state specific. Last I knew, send it to tenant's last known address via (certified mail recommended). Assuming the letter was returned due to no forwarding, you should keep it UNOPENED.
After 1 year, I believe you can retain the money as yours AT THIS TIME. Tenant has a total 6 years to reclaim this money, but CANNOT sue for double if you can demonstrate you attempted to return it.
It is definitely yours after 6 years; tenant has no recourse after 6 yr statute of limitations expires.

My lease specifies email is acceptable, and that's how I send my reconciliations. Since I am usually returning most of the money, the check is sent separately from the trust account directly to the tenant's forwarding address...which they give me because they are getting money back!
However when tenant isn't getting anything back, which has happened twice in the past few years, I still email the accounting even if they haven't left their forwarding address.
NC does not specify HOW tenant is to be notified, only that they have to receive an accounting if money is withheld and they have agreed in their lease to accept electronic communications.
And they only have six months to claim any money that is might still be due them, but if there is any money due, no one would wait 6 months to ask for it! --50.82.xxx.xx |

Yes, definitely check state laws on this. In my state, these would be escheated and turned over to unclaimed property.
I did a quick Google search and it looks like, in Ohio, it mentions doing that if a security deposit was received by "a licensed broker" and then is unclaimed for 2 years. But, I see no mention when it is the LL, not a licensed broker, that is involved.
So, I dunno. :)
