Dealing with tenant who is leaving at lease ending when I raised the rent but wants to use security deposit to pay last month rent...the lease says you cant use it to pay last month rent without getting permission in writing from landlord. They haven't always paid on time..I don't live in the same state..Is this risky? --24.18.xx.xxx

If it were intended for rent it would have been called a rent deposit, check your local/state tenant laws, most areas make it illegal to access the deposit unless the unit is empty of all furniture, food and packages, keys turned in to manager/owner.

No. Stay strong.

Protect your investment. That money will be used for cleaning and repairs.

Late fees kick in and continue until the rent is paid. Unpaid rent will trigger coirt ordered eviction on their record.

Cooy that lease page, circle it, and deliver it. I order texting a photo of it.

Stay strong. Don’t let them pressure you.

On the NICE side, my kease is clear: $100 bonus if they help is get the home rented before they leave

Another $100 bonus if the home is SPOTLESS, ready for the next res.

Money gets their attention and saves me time/lost rents.

Legally, you can't touch that deposit until they leave, turn over possession and you do an assessment of damages, financial and otherwise.

I tell tenants that their deposit is not co-mingled with the landlord's funds for a single reason: to protect THEM. The LL may not use THEIR deposit during their tenancy for any reason. --50.82.xxx.xx
