My tenant gave her "30 day notice" on Feb. 8. She says her

new lease starts March 15. I said she owes for March. She says

she wants to keep possession of house if she pays for March even

though she has said she could be out by March 1. Any ideas on

If she pays for all of March, then she is entitled to stay for all of March.

Why do you care if she stays for all of the time that she paid for?

If there is any reason that you want the property for the last half of March for your own purpose, then there ought to be some financial compromise possible.

Her lease runs from Aug. 1 through July 31 so she is breaking her lease.

I want access to the house for repairs/cleaning and for showing the place.I have written a statement for her to sign saying that she can keep possession of the house for all of March as long as she agrees to pay the utilities. She is putting off signing wanting to add her own ideas and has become quite hateful via text. --76.0.xx.xxx

Ah ha...you didn't mention her lease runs through July. Hopefully in the 'proposal' you sent her to keep through March as long as she pays utilities you said something like "this offer may be rescinded at any time prior to receiving a signed agreement from tenant", as this would have prevented her from "dragging this out". Give her a firm date by which she must have this agreement back to you.

Do you have an ELT clause in your lease? If so, she owes based on that language. File for eviction on March 1st by end of day if you don't have March rent. If you have an ELT and she does not pay it, file for the ELT recovery after she has moved out. --99.92.xxx.xxx

Second, you can't file for eviction in this case unless the tenant hasn't paid rent, notice has been served, and the doesn't pay by its expiration date. --76.120.xx.xx

Anne, if you want access to house for repairs and cleaning, I suggest you tell her you made a mistake, weren't thinking this through. Yes, she can move out by March 8, you'll switch utilities into your name at that time,she'll return keys/dispose of keys and return possession (however you do it.)

And then go re-read the threads about landlord shot over $30 rent increase. Or, about the workplace shot up over a firing of an employee.

In my NEVER humble opinion, the money in landlording, for most of us mere mortal landlords, is made off of rents or property price appreciation, of both, not all those other fees, charges, garnishments, creative financial machinations. It takes a pretty sophisticated person to manuever all of the laws, court systems to get the money out of anything besides rents. At least that is the viewpoint from my office chair. --70.92.xxx.xxx

If she pays for the month she gets to keep possession, whether or not she sleeps there or store stuff there, she is paying you. Now breaking a lease is another story. What does your lease say? If it says 30 days notice, and you accept that it what it is. If you have a ELT fee then she would owe you for that.

If you really want to get in there early, I would tell her you will refund any pro-rated days from when she notified you and turned over the keys. Otherwise, just let pay and stay. --108.4.xxx.xx

I guess the problem is that I know her new lease starts March 15 but I feel that she owes for the month of March wherever she is because of her breaking the lease. Our next lease will definitely address the consequences of wanting out early on a whim. --76.0.xx.xxx
