Do you typically go after tenants who owe past rent or just try to get them out?

Do you still issue the warrant in debt even if they move out after the 5 day quite notice?

They owe one month (1200) and said they won't pay it. They have always paid on time for the past 3 years and continue to pay the remaining months on time. They just missed the one payment but I'm still charging them late fees every j since the rent goes to pay the previous late fee and rent.

A current tenant should never owe past rent. The can miss paying current or future rent. Professional landlords serve non-payers as soon as they are legally allowed to and proceed with eviction or rent-plus-fees collection in a timely manner. No delays, acceptance of excuses, etc.

In your rental agreement you should spell out how monies received are applied. Normally monies go towards billed repairs, late fee, past due rent & finally towards current rent. IMO you tenant has not paid current rent but with their latest payment have paid money towards the late fees & the previous months.

Send them a statement starting the month before they missed a payment up thru today showing late fees, past months rents, payments received & how much they owe towards the current month. --96.237.xx.xx

No I never go after the money. I always let people stay in my home for free and as long as they want. I like people stealing from me and living free and to me this allows them to get their friends and relatives better birthday and Christmas presents. Well really they don't get them -- I actually am subsidising the tenant and the tenant gets all the accolades. The tenants relatives don't know I'm really paying.

Once the court papers are applied for-- there is an amount that is due-- and it's outlined on the papers. We don't accept anything less. Second once the file is started -- unless they give us the keys-- and or send us a notice that they have voluntarily surrendered the property-- we don't go in. Why should we/you? You've already started the process-- let the court do their thing and let the time clock continue to tick on the tenant.

So they owe: this month 1200.00 (using your number) late fee 10% $120.00 court fee about 200.00 admin fee 100.00 next months rent $1200.00 -- if they haven't given you the property back. The next months late fee 120.00 and if you did get the house back another 1200.00 for not giving proper notice. If you have a year lease they owe the whole contract amount until re-rented. Lets not forget the clean up -- since they not only didn't pay rent they skipped out and left it filthy.

YEA gotta love the potential income stream. 25% collection fee and 15% interest on debt. All toll about 5800.00+ int + 1600.00 collection. NAW! Don't go after that -- it's not enough to bother with? --99.103.xxx.xxx

I had a long term good payer miss a payment. They then moved out using the rent for that month as their new deposit. I had their security. Maybe your tenant is planning to go and using that month as their next security payment. --173.61.xxx.xx

You should search out a couple landlord groups in your area and stay with the one you like, where you will find a few who will help you answer questions about housing court timing and how this or that judge follows the state and local tenant rules, once you know this you will no longer experience past rent, you will have housing court chase away the bums so you can put in better people who have passed a screening.

This is a simple one. If your long term tenant has a major problem and needs help by paying their rent in installments, then you can give them some room to work with you.

But when a tenant makes it know they aren't going to pay rent, play catch up or make good on Past Obligations, then it's time to consider eviction.

A notice will scare them. Your conversations that, "all I wanted was my rent and you make it clear that's not one of your priority's. So either you can move and we can part as friends, OR I will evict you, report this on your credit profile giving you a negative blemish that will last 7 years". There is. No such thing as unpaid rent. Since we started Zero Tolerance on Lates we get ALL the rent ALL the time.

WHY are they refusing to pay? Lost check?? Incomplete repairs? Bad attitude? SOMETHING happened.

This should have resolved the day it was late.

We don’t argue with people or accept ANY excuse. Pay to Stay or leave, either peacefully or with a court order. It’s that simple.

At this point, file.

Also remember, people change and their life circumstances change. Good residents can go bad. The pnly way we know it happened is when they stop paying.

Also, regarding WMH’s post, check their Facebook. Perhaps there is some personal info that might help.

Yes we do go after people that owe. Also, it sounds (but of course, I have no idea since I don't see the breakdown) that there is more to the story and that this may have been "a while ago". So if they missed May rent (as an example) and it was $1200 with a late fee of $120 they owe $1320. Did they pay the $1200 but NOT the $120 or did they totally not pay anything?

If they just paid the $1200 and you charged them the $120 and now it's 10 months later so they owe you $1200 which is the equivalent of a months rent - yikes.

I'm all for Zero Tolerance - however I'm also for keeping things fair and doing the right thing. So I think for me - I'd need to know more information about what exactly happened because if they are "that good of tenants" then the comment "we're not paying" should have been rectified that day or the next business day with a proper pay or quit notice. --69.201.xx.xxx

Any tenant who announces that he refuses to pay rent owed doesn't meet my definition of a good tenant.

I start eviction on day five. I've never had a tenant owe me a full month's rent that they wouldn't pay. I give them a pay or be evicted notice on the fifth the very first time they are late and it usually tunes them right up and they make paying rent a higher priority in their budget. --98.146.xxx.xxx
