I'm having a little difficulty getting a W-9 completed by a plumber. Do I also need a copy of his driver's license? The company is his last name and plumbing added to it so I wasn't sure if I always need somebody's ID. --74.141.xx.xx |

You can submit a 1099 to the IRS without it if he won't comply in filling out a W-9. I don't believe you need the DL, you just need him to fill out his section of the W-9. --98.175.xxx.xxx |

Do not need drivers license.
It's best to get the W-9 before you pay them while you still have leverage. I've been guilty of waiting in the past as well and have had difficulty getting them at times. --40.141.xxx.xx |

That has been my experience as well. Hit or miss if it’s after the payment. So this time getting it first. But the same plumber has given difficulty in the past. So this time I got the work done and happy to pay just to soon as I get the W9 --74.141.xx.xx |

My understanding is that if you are required to file a 1099 and the person/business refuses to complete a W-9, then you are supposed to do that following:
1. Make at least 3 requests for the W-9 to be completed. Document this so that you aren't liable for penalties or fines for not obtaining it.
2. Begin backup withholding (at 28%, I think?) of any payments to them.
I know of no one who actually does that though. :)
